RESOLVED, upon the appeal, under the Zoning Code, by Robert A.
Dworsky, owner of the subject real property situate in the City of Saint
Paul at and adjacent to the northeast corner of Lexington Parkway and
Selby Avenue, particularly described as Lots 15, 16, and 17, Block 3,
Rogers' Addition to St. Paul, that the.general provisions of said Zoning
Code,',xelating to density and other requirements, hereby are determined and
varied, to the extent necessary therefor, and that a special permit hereby
is granted for the construction and maintenance, on said premises, of a
10 -unit apartment building; and that, pursuant to the application of said
Robert A. Dworsky therefor, a special permit hereby is granted to said
applicant for the construction, maintenance, and operation, on said
premises, of a 10 -car capacity special purpose off - street parking facility
for use in conjunction with said proposed 10 -unit apartment building thereon,
in acoordance with the plans therefor herebyrapproved and filed herewith;
RESOLVED FURTHER, that said appellant and his successors in interest,
in respect of said premises, in the exercise of said special permits, shall
make due compliance with all applicable State statutes and municipal ordinances.

Dear Madam:
This is in the matter of Robert Dworksy's 1) appeal to relax the density standards
and 2) application for a permit for a 10 car private off - street parking lot in con-
junction with a proposed apartment to be constructed on property which is located
at the northeast corner of Lexington Parkway and Selby Avenue and which is described
as Lots 15, 16, and 17, Block 3, Rogers Addition. The zoning is "C" Residence.
The subject property is vacant and has a frontage of 88.6 feet on Selby Avenue and
109.16 feet on Lexington Parkway resulting in an area of approximately 9,673 square
feet. Directly north and.adjoining is a two - family residence which fronts on
Lexington Parkway, farther to the north is an apartment building; east and adjoining
is a single - family residence which fronts omSelby Avenue; south and across Selby
Avenue is a two - family residence.:which fronts on Lexington Parkway; west and across
Lexington Parkway is a tavern which is a legal non - conforming use. There are scat-
tered apartment uses along Lexington Parkway in this area.
It is proposed to construct a ten -unit apartment building on a site with •a ground
area of 9,673 square feet, therefore, it is necessary to secure Council authoriza-
tion for the necessary relaxation of Section 60.24 of the Legislative Code which
requires 1,000 square feet of ground area per apartment unit.
Field investigation discloses no objection to the proposed use, or to the relaxation
of the density requirements as proposed as the deficiency is only 327 squire feet,
and the proposal is in keeping with the Land Use Plan and would be compatible with
the existing area uses. The Traffic Engineer has approved the parking lot plan
which meets the standards for this type of facility. The building ground coverage
standards are met.
In consideration of the above factors, the Board of Zoning recommends the granting
of 1) the appeal to relax the density standards, and 2) the application of the
parking lot for 10 cars in conjunction with a proposed 10 -unit apartment building on
the above described property in accordance with plans approved February 21, 1963.

Gentlemen:
The undersigned is dissatisfied with the application of the provisions
of the Zoning Code, and intends this letter to be a notice•of appeal to the
City Council pursuant to Section 64 of the Zoning Code. The undersigned,
purchaser of the above- described property, hereby makes application to the
City Council of the City of Saint Paul to vary the application of Section 60.24
of the Zoning Code of the City of Saint Paul to the construction of an
apartment building on the above property. It is proposed to construct a 10
unit apartment building on the property and a parking lot for 10 cars in accordance
with the plan which is attached hereto and filed herewith. It appears that
the land area of the entire tract is approximately 9,670 square feet, and
that the election of a 10 unit apartment building on said property would be
in harmony with the general intent and purpose of the Zoning Code and more
particularly with the density and land coverage provisions of Section 60.24.
There is herewith enclosed my check in the sum of $20.00 to cover the
fee required for the filing of this notice of appeal.
