F. Oviatt, Division Superintendent of the Great Northern Railway, and two copies of a proposed agreement from the railroad company providing for termination of an existing contract in regard to railway spur trackage at the City of St. Paul Asphalt Plant. You were asked to please review the proposed termination agreement and contract, determine if it is in order to cancel the contract and, if so, to please prepare necessary resolution or documents accomplishing such cancellation by the proper City officials. This office has again been contacted by Mr. Oviatt requesting the agreements as executed by the City officials so that the execution could be accomplished by the railway company authorities. Oviatt, Division Superintendent of the Great Northern Railway Company, and two copies of a proposed agreement from the Railroad Company providing for the termination of an existing contract in regard to railway spur trackage at the City of St. Paul Asphalt Plant. This office has been unable to find a copy of Contract No. 19416 to which reference is made in Mr. Oviatt's letter and we do not, therefore, know the con- tents of such agreement. However, spur track #3 referred to in the letter and in the proposed agreement has already been removed and the agreement formally ratifies this removal. Would you please review the proposed termination agreement and the contract, if such is on file in your office, to determine if it is in order to cancel the contract. If this may be done, would you please prepare the necessary Resolution or documents to authorize said cancellation and the execution by the proper City Officials. Please do not hesitate to call this office should you need additional information when processing this request. The executed copies of the agreement can either be returned directly to Mr. Owtatt's office or to this office for transmittal, as you wish. In this connection I am attaching in duplicate proposed termination agreement to provide for cancelling Cont. No. 191116 dated September 5,1924, Will you kindly have the agreement executed by proper Cityy Officials and return both copies to this office for execution by the Railway Comparr. When the agreement has been executed by the Railway Company, executed duplicate copy will be returned to you for your files. This trackage was removed by City forces from the Clearance point to the end and the Railway Company forces will remove the switch and make connection to track No. 2.
