RESOLVED, That the proposed Supplemental'Agree=
meet by'and between the Citycf Saint Paul and Toltz, King,
Duvall, Anderson & Associates, Inc., for additional pro-
fessional engineering services to be furnished to said
City'by said Toltz, King, Duvall, Anderson & Associates,
Inc., in extension of the professional engineering services
provided to be furnished by the latter to said City under
that certain subsisting Professional Engineering Services
Agreement by and between them, dated October 17, 19619
authorized by the prim Resolution of this Council No. 204366,
approved said date, pertaining to the Arch- Pennsylvania-
E. Minnehaha Highway Project, hereby is approved and author-
ized, provided that the same shall conform to the pertinent
proposal therefor by Toltz, King, Duvall, Anderson, &
Associates, Inc., dated February 8, 1963, a copy whereof
is herewith filed and hereby made part and parcel hereof
by reference; and that the proper City officers hereby are
authorized in behalf of said City to execute said proposed
Supplemental Agreement as the same shall be approved by
the Corporation Counsel.

Supplemental Agreement
As a result of your discussions with us regarding the necessity for an
alternate route study, we propose a Supplemental Agreement to our Professional
Engineering Services Agreement dated October 17, 1961 as follows:
(1) Alternate Route
We will make the necessary topographic surveys of the area for an
alternate route from -Mississippi Street to Payne Avenue between Collins Street
and North Street. You will furnish us with the location and alignment of the
project at the east end. The location and alignment at the west end will not be
changed. We will make ties to property corners along this alternate route so
that descriptions of property to be taken can be made. We will supervise the
necessary borings, test pits, etc. ; but the cost of such test pits, borings, etc. ,
will be paid for by the City.
Preliminary alignment, profiles and design of the highway along
the alternate route will be prepared. Preliminary design for one revised bridge
and one new bridge will be prepared. One bridge will not be changed. Esti-
mates of the cost of the work will be prepared by us. A preliminary report
for this alternate route will be submitted for your approval.
For the additional services outlined above under (1) Alternate Route,
we are to be paid an additional fee of 17o of the estimated construction cost of
the work, this sum not to exceed $17, 000. 00. This additional payment is not a
part of, the 576 fee to be paid for plans and specifications, but is in addition to all
other fees and payments provided for under the original agreement. The 5% to

the previous payment made for the original preliminary report regardless of
whether the original or alternate route is selected upon which to prepare final
plans.

mitted November 16, 1962, in arriving at this additional fee. This fee shall
be due and payable upon completion of the preliminary report.
The preliminary report required under this Supplemental Agreement will
be delivered to you within 120 calendar days after being directed to proceed with
the wo rk.

WHEREAS, The City of Saint Paul, in cooperation with the Minnesota Highway
Department, contemplates as a necessary addition to the City transportation network
a proposed bridge and roadway connection, connecting generally from Interstate 35E
andia Pennsylvania Avenue on the west to Payne Avenue on the east and lying generally
between North Street on the south and Minnehaha Slf)tXXX Avenue on the north, and
WHEREAS, Said project was included in the Second United Improvement Program,
approved in 1953 and identified as Pennsylvania Bridge project,a nd
WHEREAS, It now appears that the inadequate funds for the accomplishment of
the project, provided under said Improvement �rogram, could now be supplemented
to the necessary degree from Municipal State Aid funds and other funds 4-�4ig
WHEREAS, The firm of Toltz, King, Duvall, Anderson & Associates, Inc. has
been retained by the City to perform preliminary engineering studies and pre-
paration of final plans and estimates, and
WHEREAS, This project, including right-of -way, is expected to cost between
two and three million dollars and have major effects not only on the transportation
network, but also on the neighborhoods through which it trasverses, and
WHEREAS, It is desirable and necessary to explore )Ooroughly on a prelim mr

basis all reasonable alternatives M before proceeding with detailed
final plans, and
WHEREAS, Joint studies by the Minnesota Highway Department, the City's Public
Works Department, the City's Planning Board and representatives pf neighborhood
organizations have developed alternative , and
WHEREAS, It appears necessary and desirable that additional preliminary
engineering studies be made prior to the beginning of detailed construction plans
