WHEREAS, in connection with the Improvement described as the Realign-
ment, Grading and Paving of COMO PARK ROADWAY from Lexington Parkway
to West Como Boulevard, Comptrollert s Contract L- 6130, additional
land was acquired by the City along the north side of said roadway
between Churchill Street and the Alley east of Churchill Street prior
to the realignment, for Right -of -Way purposes; said Right -of -Way line
and the southerly line of Lot 17, Block 1, WARRENDALE ADDITION being
one and the same, and
WHEREAS, the contract plans for said Improvement provided <.fbr the '
shaping and sodding of the slope areas where the grade of the new
roadway was lower than the abutting property, and
WHEREAS, the top of the slope along the above described Right -of -Way ,
did not extend as far back as the bourdbry of said Right-of-Way,—or
tYB southerly line of said Lot 17, Block 1, WARRENDALE ADDITION,
except for a short distance at the Churchill Street terminus with the
result that this area was not included ,in the slope areas to be..
shaped and sodded, and -
WHEREAS, Albert N. Bies, 1198 Church.ill Street in this City, owner of
said Lot 17, Block 1, Warrendale Addition, desirous of beattify.ing' his
abutting property retained the Ryan Landscape Company, sub - contractor
on the City Contract, whose duty it was to do the necessary shaping
and sodding of the slopes, to landscape his property and at the same
time to make similar improvements on the City's portion of the ac-
quired Right -of -Way not included in the contract and for which payment
was made by him, and
WHEREAS, Albert N. Bies, subsequently requested that he be reimbursed
for improving the City's portion, and it was agreed that the City would
include the cost of this work in the final settlement with the Con-
tractor, but this item was inadvertently overlooked when final payment
to the Contractor was made, now therefore, be it
RESOLVED, that the Commissioner of Public Works be and he is hereby
