THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN:
Section 1. That permission and authority be and the
_same are hereby given to Hubbard Broadcasting, Inc. to construct
and maintain a conduit which will contain two 3" chilled water
lines, two 1 "*" oil lines, and one 2" water line under and across
Charles Avenue approximately 120 feet west of Berry Street measured
on the south line of Charles Avenue, a 3" low pressure gas line
under and across Charles Avenue approximately 123 feet west of
Berry Street measured on the south line of Charles Avenue, and an
oil transfer line on the south 3 feet of Charles Avenue approximate
127 feet west of Berry Street and running westerly approximately 40
feet.
Sec. 2. That the Commissioner of Public Works is hereby
authorized to issue a permit to the said licensee for the constructic
of the conduit, gas line, and oil transfer line in Charles Avenue as
described in Section 1 hereof, upon said i4p-enseels compliance with
the following express conditions, viz:
(1) The said licensee shall construct said conduit,
gas line, and oil transfer line entirely at its own
expense to the satisfaction and under the supervision
of the Commissiones.of Public Works;

(3) The said licensee, after the inception of the
work shall prosecute same continuously, with diligence,
and fully complete said work to the satisfaction and
approval of said Commissioner;
(4) The said licensee shall give a surety company
bond to the City of St. Paul in the penal sum of Five
Thousand Dollars ($5,000.00), conditioned to comply
with all the terms of this ordinance and to indemnify
and save harmless the City of St. Paul from any and
all liability, judgments, suits, costs, charges, damage
or expense that may accrue to persons or property on
account of or arising from the construction, maintenance,
operation, use, presence, or removal of said conduit,
gas line, and oil transfer line. The bond shall be in
such form as may be approved by the Corporation Counsel, -
shall have such surety as may be approved by the Com-
missioner of Finance, and be filed with the City Comp-
troller;
(5) The said licensee shall pay the cost of the
publication of this ordinance, and shall, within ten
days from and after the passage-of this ordinance, file
• written acceptance thereof with the City Clerk, in
• form to be approved by the Corporation Counsel. If
such acceptance is not filed within said time, the
authority hereby given shall be void;
(6) Said conduit, gas line, and oil transfer line shall
be removed by said licensee whenever the Council shall
so order;
(7) Said permittee shall not proceed to construct said
installations unless and until said permittee shall have
fully.complied:.with the provisions regarding insurance
and indemnification contained in the City of St. Paul
Department of Public Works Specifications for Street and
Sewer Construction dated'April 1, 1959, as amended, Section
numbered 1.44 and found on pages 1 -13 through 1 -17 of said
Specifications applicable to.contractors. For the purposes
of this ordinance, the aforesaid section of said Speci-
fications numbered 1.44 shall be read as though the word
" permittee" were substituted for the worst "contractor"
wherever the same appears in the aforesaid Section 1.44.
Said!'Section 1.44 of the Specifications for Street and
Sewer Construction in the City of St. Paul is hereby in6or-
porated herein by reference as fully and as completely

Re: Utility Service Lines in Charles Street for KSTP.
Dear Mr. Goldberg: ,
We request permission of the City of St. Paul for the installation
of a reinforced concrete pipe conduit and a private pipe gas ser-
vice to be located in the portion of Charles Street north of Berry
which ends at the KSTP property.
The enclosed duplicate prints show the proposed installation
which is to be located approximately adjacent to an existing
similar type conduit which was approxed and installed in 1961.
The proposed new conduit will contain two 3" chilled water lines,
two 1 1/2" fuel oil lines,.and one 2" water line all of which are
to be used to provide interrelated and standby type mechanical
services for the KSTP properties.
We also seek permission to install a private 3" low pressure gas
service main across Charles Street to serve the new Hubbard
Building boiler plant. This line would be installed in the ground
outside but adjacent to the above proposed new conduit. All
standard rules used for installing street gas mains will be ad-
hered to.
This project must be rushed to completion immediately and we there-
fore need a letter of intent on your decision by Tuesday, May 28,
1963.
