A public hearing having been had upon the above improvement upon due notice, and the Council
having heard all persons, objections and recommendations relative thereto, and having fully considered
the same; therefore, be it
RESOLVED, By the Council of the City of St. Paul that the precise nature, extent and kind of im-
provement to be made by the said City is to construct sanitary sewer in Totem Road from
Lower Afton Road to Burlington Road;' and in Burlington Road from the saiataier nobt
intersection of Burlington Road and Totem Road to the South line of Lot 35, Block 8,
Burlington Heights Division No. 2; all of which is to be known as the BURLINGTON
HEIGHTS SANITARY SEWER SYSTEM
and the Council hereby orders said improvement to be made, as a public necessity.
RESOLVED FURTHER, That the Commissioner of Public Works be and is hereby instructed and
directed to prepare plans and specifications for said improvement, and submit same to the Council for
approval; that upon said approval, the proper city officials are hereby authorized and directed to pro-
ceed with the making of said improvement in accordance therewith.

To the Commissioner of Finance of the City of Saint Paul:
The Commissioner of Public Works, having had under consideration the pre-
liminary order of the Council, known as Council File No. 211779
approved March 21st 19 63 relative to constructing a sanitary sewer
in Totem Road from Lower Afton Road to Burlington Road; and in Burlington Road from
the southernmost intersection of Burlington Road and Totem Road to the south line of
Lot 35, Block 8, Burlington Heights Division No. 2; all of which is to be known as
the BURLINGTON HEIGHTS SANITARY SEWER SYSTEM
and having investigated the matters and things referred to therein, hereby reports:
1. The estimated cost thereof is $51,155.52 (See Letter.Attached)
2. A plan, profile or sketch of said improvement is hereto attached and made
a part hereof.
3. Initiated by the Commissioner of Public Works

PETITION IN OPPOSITION TO- PRELIM. ORDER 211779,
BURLINGTON HEIGHTS SANITARY SEWER SYSTEM
TO THE COUNCIL OF THE CITY OF SAINT PAUL: �) f
The undersigned petitioners respectfully represent as follows: That t
are property owners who would be subject to assessments for the proposed
sanitary sewer improvement; that your petitioners have been.advised and under-
stand that the primary purpose of the proposed sewer improvement is to provide
public sanitary sewer facilities for the detention facility known as Totem
Town; that your petitioners do not oppose such public sewage facilities for
Totem Town, but do oppose the proposed Preliminary Order 211779 on the basis
that the route proposed for the sewer in this Order will place an unfair and
burdensome assessment upon the undersigned; that the undersigned do not wish
sanitary sewer service for their property and see no immediate need for
sanitary sewer service for their property; that sanitary sewer facilities
could be provided to Totem Town by running the sewer to the North gate of Totem
Town and permitting a connection on the property of Totem Town from that point,
without the necessity of the extensive sewer line as now proposed; that such
an alteration in the proposed plan would relieve the undersigned of a major
portion of the proposed assessment and would not be unfair or burdensome to
Totem Town.
That in addition to the proposed sewer improvement now before the Council,
your petitioners are advised and understand that Totem Town desires public
water facilities; that under the normal procedures followed by the Water
Department the water mains would be laid along the same course followed by the
public sewer; that before the water mains are laid it will be necessary to

grade the street in which the mains are placed; that at the present time the

this procedure is followed the undersigned will also be faced with an urfa.ir

the grading of the street which- is- mot,presently improved; that your petit
have no objection to Totem.Town receiving'-public water, but they are of the
opinion that their property does not need public water and they are opposed to
a program which would impose upon their property additional assessments for
public water and the grading of a new public road, neither of which are neces-
sary or desirable as far as their property is concerned.
That to the best information and belief of the petitioners no private
property owner has requested or petitioned for the proposed improvement, and
it is unfair to provide public sewer facilities to Totem Town in a manner
which will place the major cost of the improvement upon private property owners
such as the undersigned who oppose.the improvement and do not desire -nor need
sanitary sewer facilities.
WHEREFORE, the petitioners respectfully request that the Council.reject
the proposed Preliminary Order No. 211779 and request The Department of Public
Works to submit an alternative plan permitting the construction of sanitary
sewer facilities to Totem Town at the North gate of Totem Town or by some
other economical or feasible means.

Dear Sirss
I would like to add my thinking to the views which will
be voiced at the public hearing relative to the matter presented
on the reverse side of this paper on June 4, 1963.
Many of us who lived on the affected area of Burlington
Road wished for the availability of sanitary sewers when we had to
go to the labor and.expense of constructing septic tanks and cesspools.
We are not opposed in principle.
The opposition can be found in the unfairness of the
projected costs to be borne by the property owners. During the
years they were taxed on the same basis as if they had the fine
fire protection, policing, sidewalks, sewer, and city water that
the other neighborhoods enjoyed. However, they do not have the
advantages that the tax rate is supposed to provide. The other
problem arises from the fact that a large part of the sewer demand
will arise from county property in the area. Since this is tax
exempt property, other means of having them carry their fair load
should be worked out. Unless this can be worked out, the tax paying
property holders should not be forced to assume this heavy burden. 0
