RESOLUTION
2 BE IT RESOLVED that, upon the request of Shaw Lumber, as documented in Public Works
3 Technical Services, Vacation File Number 08-2007, the accompanying Certificates of Intended
4 Non-Use releasing utility easements, are filed voluntarily on behalf of: Comcast, a
5 Pennsylvania Corporafiou; Northern States Power d/b/a Xcel Energy-Gas Division; made a
6 part hereof by this reference and filed in the office of the City Clerk of Saint Paul, the City, for
7 itself and on behalf of these corporations, waives the right to utility easements in the vacated area,
8 described below and on attached map, Exhibit A:

RESOLVED that, subject to the herein staYed exceptions and with the accompanying Certificates
of Intended Non-Use, filed voluntarily on behalf of: Distriet Energy/District Cooling St. Paul,
a private, non-profit Minnesota corporation; Qwest Communicafions, a Delaware
CorporaYion; Saint Paul Regional Water Services, a municipal corporation; City of Saint
Paul Public Works; made a part hereof by this reference and filed in the office of the Ciry CIerk
of Saint Paul, the City, for itself and on behalf of #hese corporations and deparhnents, waives the
right to the sireet right-of-way and utility easements in the area to be vacated, described above
and subject to the following, including:
This vacation shall be subject to the terms and condition af Chapter 130, codified March 1, 1981,
of the Saint Paul Legislative Code as amended, and to the fol[owing conditions:
1. That the petitioners, their successors and assigns shall pay $1200.00, of which $300.00
has already been paid, as an administrative fee for this vacation which is due and payable
within 60 days of the effective date bf this resolution.
2. Thaf an easement shall be retained on behalf of Northem States Power Company dba XceI
(Elech�ic), a Minaesota Corporation, for its exisring facilities. The petirioner or its
svccessor shall provide new easemenTs if required and the petitioner or its successor shail
assume all costs of relocating facilities to the new easements.
3. That an easement shall be retained on behalf of Northem States Power Company dba Xcel
(Gas), a Minnesota Corporation, for its e�cisring facilities. The peYitioner or its successor
shall pravide new easements if tequired and the pefi6oner or its successor shall assume a11
costs of relocating faciliries to the new easements.
BE IT RESOLVED ihat, upon the petition of Shaw Lumber, as documented in Public Works
Technicat Services, Vacation File Number 08-2007, the public properry hereinafter described, as
follows and on attacLed map Eshibit A, is hereby vacated of its interest as sh�eet right-of-way:
