RESOLVED, That Hubbard Broadcasting, Inc., 3415 University
Avenue, be permitted tolroceed at its own peril with the con-
struction of a conduit which will contain two 3" chilled water
lines, two 11" oil lines, and one 2" water line under and across
Charles Avenue approximately 120 feet west of Berry Street measured
on the south line of Charles Avenue, a 3" low pressure gas line under
and across Charles Avenue approximately 123 feet west of Berry Street
measured on the south line of Charles Avenue, and an oil transfer line
on the south 3 feet of Charles Avenue approximately 127 feet west of
Berry Street and running westerly approximately 40 feet, subject to
all of the terms and conditions of the proposed Ordinance No. 12491.
In the event that said ordinance is not passed by the Council of the
City of Saint Paul, Hubbard Broadcasting, Inc. agrees to remove the
subject installations and to restore the street to its original
condition, to the satisfaction of the Chief Engineer of the City of
Saint Paul; be it
FURTHER RESOLVED, That during the period of construction,
Hubbard Broadcasting, Inc. must agree to protect the City of
Saint Paul and the public according to the pertinent provisions of
said proposed Ordinance No. 12491; be it
FURTHER RESOLVED, That Hubbard Broadcasting, Inc. accept
the terms and conditions herein, and the terms and conditions of the
'proposed ordinance in the form of a letter signed by a duly authorized
officer of the corporation, which shall be filed with the City Clerk
of the City of Saint Paul within five days of the passage of this
Resolution.
