WHEREAS, Richard C. Gilbert, Richard E. Meyer 96,: y,
Howard Korlath, employees of the Department of Public Safety;
Bureau of Fire Protection, were involved in a third -party
accident occurring on or about January 31, 1961, with a
vehicle of the Twin City Rapid Transit Company, and sustained
personal injuries on account of said accident, and the City of
Saint Paul has expended on behalf of said employees a total of
$$478.90 in medical expense and $217.14 in salary during the
period of their disability; and
WHEREAS, a settlement has been reached as between
said employees and their counsel, Mansur and Mansur, and the
other party involved in said third -party accident and the City
has been offered a compromise settlement, solely in connection
with the personal injuries of its employees and its expenditures
on their behalf;- -.the matter of its property damage to the Fire
Department vehicle having been settled previously, and the
office of the Corporation Counsel recommends the acceptance
from the third party involved of said settlement figure of $225.00;
and
WHEREAS, the City's subrogation claim for medical
expense and salary expended on behalf of said employees, in
their action against said third party, was represented by
the employees' attorneys, Mansur and Mansur, and there should
be paid to them as attorney fees one - fourth of said settlement,
or $56.25,
Now, Therefore, be it
RESOLVED, That the proper City officers are hereby
authorized to accept in full, final and complete settlement of
its subrogation claim for injury to its employees in said third -
party accident of January 31, 1961, the sum of $225.00, to be .
credited to the Workmen's Compensation Fund, and to execute any
necessary releases therefor, and to pay to said attorneys, Mansur
and Mansur, the sum of $56.25 out of said Fund as attorney fees
in connection with said settlement. .SUN 19 1963
