1 BE IT RESOLVED, that upon execution and delivery of a release in full to the City of St. Paul, the
2 proper City officers are hereby authorized and directed to pay out of the Tort Liability Fund 09070-
3 0511 to Ying Xiong and her attorney Scott P. Heins, the sum of $12,750.00; to Xee Xiong and her
4 attorney Scott P. Heins, the sum of $12,750.00; and Pasha Yang and her attorney Scott Heins, the
5 sum of $10,750.00, in full and final settlement of their claim for damages sustained on June 18,
6 2005, as a result of an automobile coliision which occurred with a driver of a vehicle owned by the
7 City of St. Paul.

Initiating Problem, Issues, Opportunity (Who, What, When, Where, Why);
Ying Xiong, Xee Xiong and Pasha Yang each initiated actions in Ramsey County District Cour� to recover damages from the City of
St. Paul for injuries they sustained in a collision with Lawrence Langlois, a Community Service Officer who was driving a Police
squad caz owned by the City of St. Paul. Ying Xiong, Xee Xiong and Pasha Yang claim Lawrence Langlois was responsible for the
accident and they should be compensated for their injuries and damages.
Advantages If Approved:
If approved, the proposed settlement would allow the City to dispose of this case without an admission of liability or a negative
determination by the court. The City also would avoid expert witness expenses and costs of ri`ial.
Disadvantages If Approved:
If this matter pxoceeds to ffial, the City would incut the expense of an expert witness. In addition, the juty could deternvne that
Lawrence Langlois was fully responsible and award plaintiffs damages in excess of the proposed settlement amount.
