THIS SUPPLOMNTAL AGFMKW made and entered into by and between
the State of Minnesota, Department of Highways, hereinafter referred to as
the "State", and the QLty of St. Pahl, Minnesota, acting by and through its
City Council, hereinafter referred to as the "City",

YHZREAS the State did enter into an agreement with the City,
dated Nay 25, 1963, and designated as Mimesota Highway Department Agreement
No. 53673, whereby the City did agree to relocate certain conduits and
cables to relocated power service points an recpired to maintain operation
of its street lighting facilities in the Capitol Approach Areas and
WHIRLS said Agreement did provide that said sables and conduits

be relocated by the City substantially as shown on Exhibit "A ", attached
thereto and made a part thereof; and
WHEREAS the construction of the Trunk Highway Interchange will require
the relocation of additional cables and conduits in order to maintain operation
of City street lighting standards;
IT IS, THEREFORE, MUTUALLY AGREED AS FOLLOWS:

Paragraph (a) of Article II of said Agreement No. 53673 is hereby
amended and modified to include the following:
The City shall install cable and conduit between existing lighting
circuits as required to maintain operation of its street lighting facilities
substantially as shown on Exhibit "A" Supplement No. 1, attached hereto and
made a part hereof. Said Exhibit "A" Supplement No. 1 shows the approximate
location of the work to be performed by the City hereunder. The City shall
perform said work with its own forces, and shall furnish all labor, material
and equipment required in connection therewith.

Attached hereto and marked Exhibit "B" Supplement No. 1 is an
estimate of the cost of installing said additional cable and conduit. This
cost estimate totals $1+88.60. This sum is in addition to that shown in
the second paragraph of Article VI of said Agreement No. 53673. Therefore,
said second paragraph of Article VI is hereby amended and modified to read
as follows:
It is estimated that the cost of work to be performed under
Agreement No. 53673 and Supplement No. 1 thereto is in the sum of $4,039.96.

In the event it appears at any time that such cost will exceed said sum,
the City shall promptly notify the Utilities and Agreements Engineer of the
Department of Highwaye thereof in order that the State may encumber such
additional funds as may be deemed necessary.
III
Except as amended and modified herein, all of the terms and
conditions of said Agreement No. 53673, dated May 25, 1963, shall otherwise
regain in full force and effect.
IV
Before this contract becomes binding and effective, it shall be
approved by an appropriate resolution of the City Council, and it shall also
receive the approval of the Bureau of Public Roads and of such State officers
as the law may provide in addition to the Commissioner of Highways.
IN TESTIMONY WH&REOF the parties have duly executed this Agreement
by their duly authorised officers and chased their respective seals to be
hereunto affixed.
