Laid over Sumuiary Abatement Assessment: J0713A Clean up done from July 20 to August 14, 2007 for property at 89 Atwater Street (J0713A) Mr. Magner stated orders were issued on August 6, 2007 to empty overflowing refuse containers, and to clean up refuse and debris on the ground with a compliance date of August 9. The property was re- inspected on August 9 and the work had not been done. A work order was sent to the Parks Deparfinent who did the work on August 10, 2007 for a total assessment of $358. Don McGee, property owner, appeazed and stated that he assumed his tenants had trash service at the property as that was part of their lease agreement that they provide their own service and he paid for everything else. Mr. Magner stated that the Legislative Code requires the owner to provide trash service. Ms. Moermond asked to see the video tape which showed an overflowing BFI trash container as well as loose and scattered debris that was cleaned up by the City crew. Ms. Moermond asked whether the City was providing gazbage service to this property. Mr. Magner responded that the City currently was not providing service; however, the City was monitoring the property as there had been several complaints regarding overflowing trash containers. There was also a complaint concerning the same offense back in February. Ms. Moermond asked Mr. McGee how many tenants were living in the building. Mr. McGee responded that there were two. Ms. Moermond stated that he obviously did not have enough containers. Mr. McGee responded that his upstairs tenant took his trash to work as he couldn't afford to pay for trash service. Ms. Moermond recommended reducing the assessment from a total of $358 to a total of $258. She told Mr. McGee that she would not consider forgiving any future assessments far this offense.
