O'Connell City Clerk Building Dear Madam: This is in the matter of the Crown Builders Inc. "s 1) appeal to establish a 30 foot building line setback from Maryland Avenue, and 2) application to install and operate a 110 car private off - street parking lot in conjunction with five apartment buildings with a total of 109 units on property located at the northwest corner of Arundel Street and Maryland Avenue. The property is described as Lot 40 except the north 200 feet thereof, subject to an ease- ment for street purposes over the east 60 feet thereof, and the south 30 feet thereof, Cottage Homes. This property was rezoned to commercial in two par- cels, one on September 10, 1960 and the balance on November 5, 1960. The site is vacant and has a frontage on the north side of Maryland Avenue of 271 feet and a frontage on the west side of Arundel Street of 402 feet, result- ing in an area of approximately 109,154 square feet. Because of the extreme depth of the lot, a setback of 80 feet would be required by the Legislative Code and the applicant is asking for a reduction of the requirement to 30 feet. North and adjoining is a recently constructed roller- skating rink; to the east and across Arundel Street is a single - family residence which fronts on Mary- land Avenue, also a nursery and greenhouses; south and across Maryland Avenue is a recently constructed single - family residence, and an apartment building which fronts on Maryland Avenue; west and adjoining is vacant land. Field investigation discloses no basic objection to this proposal as apart- ments are permitted in a commercial district and the proposed development meets the density requirements. The requ=ested 30 foot building line appears to be reasonable. It would not be detrimental,to any of the adjacent property, and the relaxation, as requested, would be in keeping with the purpose and intent of the Code. The Traffic Engineer recommends approval of the parking plan which meets the standards for this type of facility. In consideration of the above factors, the Board of Zoning recommends the granting of 1) the appeal to establish a 30 foot building line setback from Maryland Avenue and 2) the application for a permit for a 110 car private off - street parking lot on the above described property in accordance with plans approved May 9, 1963 as reflected in the revised plan dated May 29, 1963.
