1 WHEREAS, Department of Safety and Inspections has requested the City Council to
2 hold public hearings to consider the advisability and necessity of ordering the repair or wrecking
3 and removal of a one and one-half story, wood frame/stucco, single family dwelling located on
4 property hereinafter referred to as the "Subject Property" and commonly known as 1098
5 SYLVAN STREET. This property is legally described as follows, to wit:

WHEREAS, based upon the records in the Ramsey County Recorder's Office and
information obtained by Department of Safety and Inspections on or before March 31, 2007, the
following are the now known interested or responsible parties for the Subject Property: MERS,
10790 Rancho Bernardo Road, San Diego, CA 92127; Usset and Weingarden , 4500 Park Glen
Road, Suite 300, Minneapolis, MN 55416; Michael Olson — Kelli Williams, 8425 Seasons Pkwy
#101, Woodbury MN 55125; District 6 Planning Council, district6 qwestoffice.net
WHEREAS, Deparhnent of Safety and Inspections has served in accordance witb the
provisions of Chapter 45 of the Saint Paul Legislative Code an order identified as an"Order to
Abate Nuisance Building(s)" dated June 16, 2007; and
WHEREAS, this order informed the then known interested or responsible parties that the
structure located on Yhe Subject Property is a nuisance building(s) pursuant to Chapter 45; and
WHEREAS, this order informed the interested or responsible parties that they must repair
or demolish the structure located on the Subject Property by August 15, 2007; and
WHEREAS, the enforcement officer has posted a placard on the Subject Property
declaring this building(s) to constitute a nuisance condition; subject to demolition; and
WHEREAS, this nuisance condition has not been corrected and Department of Safety
and Inspections requested that the City Clerk schedule public hearings before the Legislative
Hearing Officer of the City Council and the Saint Paul City Council; and
WHEREAS, the interested and responsible parties have been served notice in accordance
with Yhe provisions of Chapter 45 of the Saint Paul Legislative Code, of the time, date, place and
purpose of the public hearings; and
WHEREAS, a hearing was held before the Legislative Hearing Officer of the Saint Paul
City Council on Tuesday, October 9, 2007 to hear testimony and evidence, and after receiving
testimony and evidence, made the recommendation to approve the request to order the interested
or responsible parties to make the Subject Property safe and not detrimental to the public peace,
health, safety and welfare and remove its blighting influence on the community by demolishing
and removing the structure in accordance with all applicable codes and ordinances. The

demolition of the structure to be completed within fifteen (15) days after the date of the Council
Hearing; and
WHEREAS, a hearing was held before the Saint Paul City Council on Wednesday,
November 7, 2007 and the testimony and evidence including the action taken by the Legislative
Hearing Officer was considered by the Council; now therefore
BE IT RESOLVED, that based upon the testimony and evidence presented at the above
referenced public hearings, the Saint Paul City Council hereby adopts the following Findings and
Order concerning the Subject Property at 1098 SYLVAN STREET.
That the Subject Property comprises a nuisance condition as defined in Saint Paul
Legislative Code, Chapter 45.
2. That the costs of demolition and removal of this building(s) is estimated to exceed
five thousand dollars ($5,000.00).
That there now exists and has existed multiple Housing or Building code
violations at the Subject Property.
4. That an Order to Abate Nuisance Building(s) was sent to the then known
responsible parties to correct the deficiencies or to demolish and remove the
building(s).

That the deficiencies causing this nuisance condition have not been corrected.
That Department of Safety and Inspections has posted a placard on the Subj ect
Property which declares it to be a nuisance condition subject to demolition.
That this building has been routinely monitored by Department of Safety and
Inspections, Vacant/Nuisance Buildings.
That the known interested parties and owners are as previously stated in this
resolution and that the notification requirements of Chapter 45 have been fulfilled.

The Saint Paul City Council hereby makes the following order:
The above referenced interested or responsible parties shall make the Subject Property
safe and not detrimental to the public peace, health, safety and welfare and remove its
blighting influence on the community by demolishing and removing the structure in
accordance with all applicable codes and ordinances. The demolition and removal of the
structure must be completed within ���-'�..` five 5 days after the date of the Council
Hearing.

If the above corrective action is not completed within this period of time Deparhnent of
Safety and Inspections is hereby authorized to take whatever steps aze necessary to
demolish and remove this structure, fill the site and charge the costs incurred against the
Subject Property pursuant to the provisions of Chapter 45 of the Saint Paul Legislative
Code.
In the event the building is to be demolished and removed by the City of Saint Paul, all
personal property or fixtures of any kind which interfere with the demolition and removal
shall be removed from the property by the responsible parties by the end of this time
period. If all personal property is not removed, it shall be considered to be abandoned
and the City of Saint Paul shall remove and dispose of such property as provided by law.
It is further ordered, that a copy of this resolution be mailed to the owners and interested
parties in accordance with Chapter 45 of the Saint Paul Legislative Code.

The Department of Safety and Inspections has declared this building(s) to constitute a
"nuisance" as defined by Legislative Code, Chapter 45. The Department of Safety and
Inspections has issued an order to the then known responsible parties to eliminate this
nuisance condition by correcting the deficiencies or by razing and removing this
building(s).
The property was re-inspected on August 16, 2007. There was no compliance and the
nuisance condition remains unabated, the community continues to suffer the blighting
influence of this property. It is the recommendation of the Deparhnent of Safety and
Inspections that the City Council pass a resolution ordering the responsible parties to
either repair, or demolish and remove this building in a timely manner, and failing that,
authorize the Departrnent of Safety and Inspections to proceed to demolirion and removal,
and to assess the costs incuned against the real estate as a special assessment to be
collected in the same manner as taxes.

The building is a 1%z -story, wood frame stucco, single family dwelling on a lot of 5227 square
feet.
According to our files, it has been a vacant building since January 5, 2007.
The current property owner is MERS, per AMANDA and Ramsey County property records.
The City of St. Paul has boarded this building to secure it from trespass.
There have been four (4) SiJMMARY ABATEMENT NOTICES since 2007.
There have been two (2) WORK ORDERS issued for:
- Removal of improperly stared refuse
On June 26, 2007, an inspection of the building was conducted, a list of deficiencies which
constitute a nuisance condition was developed and photographs were taken. An ORDER TO
ABATE A NUISANCE BUILDING was posted on July 16, 2007 with a compliance date of
August 15, 2007. As of this date this property remains in a condition which comprises a nuisance
as defined by the legislative code.
The Vacant Building registration fees are paid.
Tazcation has placed an estimated market value of $56,600 on the land and $79,600 on the
building.
As of March 7, 2007 a Code Compliance inspection has been completed.
As of October 8, 2007, the $5,000.00 performance bond has not been posted.
Real Estate taxes are current.
Code Enforcement Officers estimate the cost to repair this structure is $SQ000-$60,000. The

On June 26, 2007, a Building Deficiency Inspection Report was compiled and the
following conditions were observed.
This list of deficiencies is not necessarily all the deficiencies present at this time. As
first remedial action, a Code Compliance Inspection must be obtained from the
Building Inspection and Design Section, 8 Fourth Street East, Suite 200, Commerce
Building (651)266-9090. That inspection will identify specific defects, necessary
repairs and legal requirements to correct this nuisance condition. You may also be
required to post a�ve thousand dollar ($5,000.00} performance bond with the
Building Inspection and Design Office before any permits are issued, except for a
demolition permit.

This building(s) is subject to the restrictions of Saint Paul Ordinance Chapter 33.03 and
shall not again be used for occupancy unril such tnne as a Certificate of Compliance or a
Certificate of Occupancy has been issued.
This is a one and one-half story, wood frame, single family dwelling
Exterior
1. The eaves and soffits are in a state of disrepair or deterioration. Repair
all defects, holes, breaks, loose or rotting boards, to a professional state
of maintenance. Permit may be required.
2. The exteriar walls and/or trim of tlae house and/or garage has defective,
peeled, flaked, scaled or chalking paint or has unpainted wood surfaces.
Scrape and repaint to effect a sound condition in a professional manner.
3. The foundation is deteriorated, defective or in a state of disrepair.
Repair all foundation de£ects in a professional manner to a
weather-tight, water-tight and rodent-proof condition. Permit may be
required.
4. There are missing or defective guardrails. Provide all stairways,
porches, decks or steps which are more than 30" high with guardrails
and intermediate rails with openings in the guardrail no more than four
(4) inches apart and in accordance with the State Building Code.
5. The roof is deteriorated, defective, or in a state of disrepair. Repair or
replace the roof covering to a sound, right and water impervious
condition. Permit may be required.
6. The exterior walls of the house and/or garage are defecrive. Repair all
holes, breaks, loose or rotting siding, to a professional state of
maintenance.
The window and/or door screens are missing, defective or in a state of
disrepair. Provide proper window and door screens for all openable
windows and doors. Screens must be tight-fitting and securely fastened
to the frames.
8. The windows and/or storm windows are in a state of disrepair. Replace
all missing or broken window glass. Make all necessary repairs to
frames, sashes, hardware and associated him in a professional manner.
Permit may be required.

9. The bathroom floor covering is deteriorated or inadequate. Provide
floor covering which is impervious to water and easily cleanable
throughout the bathroom and seal around the edges and fixtures.
10. FURNACE: Have a licensed heating contractor service and clean the
furnace or boiler and make any necessary repairs. Perform a C/O test on
the heating plant. Then, send the attached form back to the Inspector.
Repair of gas fired appliances requires a pemut.
11. Lack ofNatural Gas Service. Immediately restore natural gas service.
Failure to provide natural gas service will result in these premises being
declared Unfit for Human Habitation and ordered vacated for lack of
this basic facility.
12. The stairs have missing or defective handrails. Provide all interior and
exterior stairways and steps of more that three (3) risers with handrails
which are grippable and installed 34" to 38" above the nose of the stair
treads.
13. The interior walls are defective. Repair all wall defects and finish in a
professional manner.
14. Smoke Detector: Lack of properly installed and operable smoke
detector. Provide functioning smoke detectors in accordance with the
attached requirement, within 24 hours.
15. Numerous plumbing deficits. Repair/replace a11 defects.
16. DEFECTIVE STATRS. Stairs are broken, defective, or in disrepair.
Repair in a professional manner.
17. Evidence of improper wiring. Have a licensed electrical contractor make
all necessary repairs and certify the integrity of electrical system.
As owner, agent or responsible party, you are hereby notified that if these deficiencies and
the resulting nuisance condition is not corrected by August 15, 2007 the Deparhnent of
Safety and Inspections, Division of Code Enforcement, will begin a substantial abatement
process to demolish and remove the building(s). The costs of this action, including
administrative costs and demolition costs will be assessed against the property taYes as a
special assessment in accardance with law.

As first remedial action, a Code Compliance Inspection Report must be obtained from the
Building Inspection and Design Section, 8 Fourth Street, Suite #Z00, Commerce Building,
(651)266-9090. This inspection will identify specific defects, necessary repairs and legal
requirements to correct this nuisance condition.
As an owner or responsible party, you are required by law to provide full and complete
disclosure of this "Order to Abate" to ail interested parties, all present or subsequent
renters and any subsequent owners. If you sell, transfer, or convey in any manner, the
ownership or responsibility for this propefty, you must within seven (7) days, notify the
Enforcement Officer with the names and addresses of any new owners or responsible
parties.
The Enforcement Officer is required by law to post a placard on this property which
declares it to be a"nuisance condition", subject to demolition and removal by the City.
This placard shall not be removed without the written authority of the Department of
Safety and Inspections, Division of Code Bnforcement. The deparhnent is further
required to file a copy of this "Order to Abate" with the City Clerk's Office.
If corrective action is not taken within the time specified in this order, the Enforcement
Officer will notify the City Council that abatement action is necessary. The City Clerk
will then schedule dates for Public Hearings before the City Council at which time
testimony will be heard from interested parties. After this hearing the City Council will
adopt a resolution stating what action if any, it deems appropriate.
If the resolution calls for abatement action the Council may either order the City to take
the abatement action or fix a time within which this nuisance must be abated in
accordance with the provisions of Chapter 33 of the Saint Paul Legislative Code and
provide that if corrective action is not taken within the specified time, the City shall abate
this nuisance. The costs of this action, including administrative costs will be assessed
against the property as a special assessment in accordance with law.

21. Any franung members that do not meet code (where wall and ceiling covering is
removed, members that are over-spanned, over-spaced, not being carried properly,
door and window openings that are not headered, etc.) are to be reconstructed as per
code.
22. Habitable rooms with new usage, replaced windows shall have glass area equal t o
8% of floor azea, or a minimum of 8 sq. ft., one-half of which shall operate and all
bedroom windows shall meet emergency egress requirements (20" wide minunum,
24" high m;n;mum but not less than 5.7 sq. ft. overall).
23. Provide general clean-up of premise.
24. Provide smoke detectots as per the Minnesota State Building Code.

1098 Sylvan Street lies within the boundaries of the Tri Area Block Club. Our members strongly
support the demolition of the structure on that property. This has been an ongoing problem
rentai properry for years. Attached are copies of letters documenting concerns and sent to
owners of the properiy as faz back as 1999 & 2�00. It became evident that contacting owners
was ttot always productive, particulazly in the past several years.
Our concems have been about tenants' behauiors as wetl as property maintenance. Even when
the tenants changed, the behavior and problems did not, nor did the condition of the praperty.
These groblems were not limited to the inside of the dwelling; they were blatant, "in yotar face"
and impacted a large radius in our neighborhood Peopie would even avoid walking past that
address. EYaznpies of what we endured are as foilows:
• A lack of effort to improve/repair/maintain the property
• Deteriorated structure, broken windows, torn screens
• Tall weeds and, at most times, no grass or ground covar
• Fights, yelling, loud music, profanity
• Excessive in/out vehicular and fooi traffic — susgicious activity
• Threatening comments
• Drug use and sales in the open
• Grocery carts in the yard, on the sidewalk and the boulevazd
• At one time, additional peopte were living in a traiter in the backyard (electricat cords ran
into the house)
• Large numbers of people living at that address to the extent that nei�bors were unsure as
to who actuaily were the legitimate tenants
• Overflowing trash/insufficient or no container
• Unsupervised, unruly, disrespectful youth that wandered the streets and were a constant
source of vandalism, litter, noise, profanity, as�d hazassment to the point they would "take
over" neighboring properties by hanging on wa11s, steps, front yazds, and block streets
and traffic - particularly the intersections at Sylvan and Jessamine and Sylvan and
Magnolia
• Behaviors intimidating to passersby
• Litter/trash in the yard, on the sidewalk and boulevard, up and down Sylvan Street — at
times there would be a trail of litter in the street from 1098 Sylvan to Sylvan Rec Center
3 blocks away
• Problem tenants from 1098 often engaged in public disputeslfights with tenants of other
problem properties along Jessamine Avenue
Simply put, the structure at 1098 Syivan Street has been used, abused, and neglected beyond
repair; it is no longer salvageabie.

The Tri Area Block Club, which encompasses 76 square biocks, is actively working
with the Sairjt PauV Police Department, the District Six Pianning Councii, the Heafth
Dapartment, as we(l as area residents to deai with issues that inciude crime, drugs,
noise, unkept praperty, and siml(ar problems. Beyond proteciing our property, we care
about our community as a piace in which to live and to raise our children. Members
regularly waik and drive throughout the area to insure the livability of our
neighborhood. Members, not yust those in the immediate vicinity of i 098 Syivan, have
observed suspicious activfties at that address.
Continuing probiems inciude:
_ Suspicious activsty dus to a{arge vo{ume of inJOUt traffic, both foot and vehicular.
Due to the numbers, we are unsure of who/how many tenants aCtually belong ta 1098
Syivan.
_ Large numbers of children continue to be a problem. They do not respect
property boundaries and have been seen going into other peoples' maii boxes.
After the recent fire,around 11 pm and weil beyond curFew, severai biock ciub
members observed four youths approach and look into every parked car for thcee
blocks. They then entered 1098 Sylvan. In light of recent car break-inslvandalism,this
activity was suspicious.
On the night of the fire, most "visitoss° drove oi� in a txsrry before emergency
vehicles arrived. After the fire, a steady stream of foot and vehicular traffic cautiousfy
came back to the house.
We wiii continue to monitor and report a41 suspicious activity to the Saint Pauf Police.
The SPPD, through their crime prevention unit, offers training and assistance to
landlords and couid assist with tenant screenings prior to rental. it is our hope that you
care about the value of your property at 1098 Sylvan as wel! as its impact on our
community and wiif caoperate in resoiving this probiem.

Ordering the owner to remove or repair the buiIding(s) af 1098 S�an Street within fi$een (15)
days from adoption ofresolution.
Mr. Magner stated the building was a one and one- half story, wood frame, single-family dwelling on a
lot of 5,227 square feet and had been vacant since January 5, 2007. A code compliance inspection had
been done on Mazch 7, 2007. Tfie vacant building regisiration fees were current and the $5,000
performance bond had not been posted. On June 26, 2007, an inspection of the building was done and
a list of deficiencies which constitute a nuisance condition was developed. An order to abate a
nuisance building was posted on JuIy 16, 2007 with a compliance date of August 15, 2d07. To date,
the property remained in a condition which comprised a nuisance as defined by the Legislative Code.
Ramsey County Taz�ation estimated the market value of the land to be approxnnately $56,600 and the
building to be $79,600. Real estate tases for were cunent. Code Enforcement estimates the cost to
repair the building to be approximately $50,000 to $60,000. The cost for demolition was estimated to
be approximately $8,000 to $10,000. There had also been four sumsnary abatements issued to this
property since 2007, two of which went to work order: ta secure the building and the City had to
boazd the building to secure it from trespass, and remove improperly stored refuse. Mr. Magner read
into the record a letters received from the following on the desire to have the building demolished:
Kerry Antrim, District 6 Planning Council; the Tri Area Block Club along with attached letters from
1999 and 2000; and a letter with 36 signatures. Code Enforoement reconunends the building be
repaired or removed within 15 days. Mr. Magner presented photographs of the property.
The property owner of record, MERS, did not appear. Michael Olson, the REO far the property, did
not appear. No other parties of interest appeared.
Mr. Moermond recommended the building be removed within 15 days with no option for repair.
