WHER�AS, Department of Safety and Inspections has requested the City Council to
hold public hearings to consider the advisability and necessity of ordering the repair or wrecking
and removal of a one-story, wood frame, single family dwelling and the detached, one-stall,
wood frame, gazage with workshop located on property hereinafter referred to as the "Subject
Property" and commonly known as 835 JUNO AVE. This property is legally described as
follows, to wit:

WHEREAS, based upon the records in the Ramsey County Recorder's Office and
information obtained by Department of Safety and Inspections on or before March 31, 2007, the
following are the now known interested or responsible parties for the Subject Property: Sunrise
Prop Twin Cities Inc., 801 l St East, Hastings MN 55033-1333; Gemini Equity Crroup LLC,
3141 Dean Court Room #303, Minneapolis, MN 55416; West Seventh/Fort Road Federation,

WHEREAS, Deparhnent of Safety and Inspections has served in accordance with the
provisions of Chapter 45 of the Saint Paul Legislative Code an arder idenfified as an "Order to
Abate Nuisance Building(s)" dated July 13, 2007; and
WHEREAS, this order informed the then known interested or responsible parties that the
structure located on the Subject Property is a nuisance building(s) pursuant to Chapter 45; and
WHEREAS, this order informed the interested or responsible parties that they must repair
or demolish the structure located on the Subject Property by July 13, 2007; and
WHEREAS, the enforcement officer has posted a placard on the Subject Property
declaring this building(s) to constitute a nuisance condition; subject to demolition; and
WHEREAS, this nuisance condition has not been corrected and Department of Safety
and Inspecrions requested that the City Clerk schedule public hearings before the Legislative
Hearing Officer of the City Council and the Saint Paul City Council; and
WHEREAS, the interested and responsible parties have been served notice in accordance
with the provisions of Chapter 45 of the Saint Paul Legslative Code, of the rime, date, place and
purpose of the public hearings; and
WHEREAS, a hearing was held before the Legislarive Hearing Officer of the Saint Paul
City Council on Tuesday, October 9, 2007 to hear tesrimony and evidence, and after receiving
testimony and evidence, made the recommendation to approve the request to order the interested
or responsible parties to make the Subject Property safe and not detrimental to the public peace,
health, safety and welfare and remove its blighting influence on the community by rehabilitating
this structure in accardance with all applicable codes and ordinances, or in the alternative by

demolishing and removing the structure in accordance with all applicable codes and ordinances.
The rehabilitation or demolirion of the structure to be completed within fifteen (15) days after the
date of the Council Hearing; and
WHEREAS, a hearing was held before the Saint Paul City Council on Wednesday,
November 7, 2007 and the testimony and evidence including the action taken by the Legislative
Hearing Officer was considered by the Council; now therefore
BE IT RESOLVED, that based upon the testimony and evidence presented at the above
referenced public hearings, the Saint Paul City Council hereby adopts the following Findings and
Order concerning the Subject Property at 835 JiTNO AVENUE.
That the Subject Properry comprises a nuisance condirion as defined in Saint Paul
Legislative Code, Chapter 45.

That the costs of demolition and removal of this building(s) is esrimated to exceed
five thousand dollars ($5,000.00).
That there now exists and has existed multiple Housing or Building code violations
at the Subject Property.
4. That an Order to Abate Nuisance Building(s) was sent to the then known
responsible parties to correct the deficiencies or to demolish and remove the
building(s).

That the deficiencies causing this nuisance condition have not been corrected.
That Department of Safety and Inspections has posted a placard on the Subject
Property which declares it to be a nuisance condition subject to demolition.
That this building has been routinely monitored by Department of Safety and
Inspections, Vacant/Nuisance Buildings.
8. That the known interested parties and owners are as previously stated in this
resolution and that the notification requirements of Chapter 45 have been fulfilled.
ORDER
The Saint Paul City Council hereby makes the following order:
The above referenced interested or responsible parties shall make the Subject Property
safe and not detrimental to the public peace, health, safety and welfare and remove its
blighting influence on the community by rehabilitating this structure and correcting all
deficiencies as prescribed in the above referenced Order to Abate Nuisance Building(s) in
accordance with all applicable codes and ordinances, or in the altemative by demolishing
and removing the structure in accordance with all applicable codes and ordinances. The
rehabilitation or demolition and removal of the structure must be completed within €1'teea
(� one-hundred eightv (180) days after the date of the Council Hearing.

2. If the above corrective action is not completed within this period of time Department of
Safety and Inspections is hereby authorized to take whatever steps aze necessary to
demolish and remove this structure, fill the site and charge the costs incurred against the
Subject Property pursuant to the provisions of Chapter 45 of the Saint Paul Legislative
Code.

In the event the building is to be demolished and removed by the City of Saint Paul, all
personal property or fixtures of any kind which interfere with the demolition and removal
shall be removed from the property by the responsible parties by the end of this time
period. If all personal property is not removed, it shall be considered to be abandoned and
the City of Saint Paul shall remove and dispose of such property as provided by law.
It is fiuther ordered, that a copy of this resolution be mailed to the owners and interested
parties in accordance with Chapter 45 of the Saint Paul Legislative Code.

The Department of Safety and Inspections has declared this building(s) to consritute a
"nuisance" as defined by Leb slative Code, Chapter 45. The Deparhnent of Safety and
Inspections has issued an order to the then known responsible parties to eliminate this
nuisance condition by correcting the deficiencies or by razing and removing this
building(s).
The property was re-inspected on August 16, 2007. There was no compliance and the
nuisance condition remains unabated, the community continues to suffer the blighting
influence of this property. It is the recommendation of the Department of Safety and
Inspections that the City Council pass a resolution ordering the responsible parties to
either repair, ar demolish and remove this building in a timely manner, and failing that,
authorize the Department of Safety and Inspections to proceed to demolition and removal,
and to assess the costs incurred against the real estate as a special assessment to be
collected in the same manner as taYes.

The building is a 1-story, wood frame, single family dwelling with a detached one-stall, wood
frame garage on a lot of 4792 squaze feet.
According to our files, it has been a vacant building since November 17, 2006.
The current property owner is Sunrise Prop Twin Cities Inc, per AMANDA and Ramsey County
property records.
There have been four (4) SUMMARY ABATEMENT NOTICES since 2006.
There have been zero (0) WORK ORDERS issued.
On 7une 25, 2007, an inspection of the building was conducted, a list of deficiencies which
constitute a nuisance condition was developed and photographs were taken. An ORDER TO
ABATE A NLTISANCE BUILDING was posted on 7uly 13, 2007 with a compliance date of
August 13, 2007. As of this date this property remains in a condition which comprises a nuisance
as defined by the legislative code.

Chapter 45.02, and subject to demolition under authority of Chapter 45.11.
On June 25, 2007, a Building Deficiency Inspection Report was compiled and the
following conditions were observed.
This list of deficiencies is not necessarily all the deficiencies present at this time. As
first remedial action, a Code Compiiance Inspection must be obtained from the
Building Inspection and Design Section, 8 Fourth Street East, Suite 200, Commerce
Building (651)266-9090. That inspection will identify specific defects, necessary
repairs and legal requirements to correct this nuisance condition. You may also be
required to post a£tve thousand dollar ($5,000.00) performance bond with the
Building Inspection and Design Office before any permits are issued, except for a
demolition permit.
This building(s) is subject to the restrictions of Saint Paul Ordinance Chapter 33.03 and
shall not again be used for occupancy until such tune as a Certificate of Compliance or a
Certificate of Occupancy has been issued.
This is a one-story, wood frame, single family dwelling with a detached, one-stall, wood
frame garage and workshop.

The exterior walls of the house and/or garage are defective. Repau all
holes, breaks, loose or rotting siding, to a professional state of
maintenance.
2. The foundarion has vertical and step cracking; spalling concrete;
deteriorated mortu joints; erumbling block face.
3. The window and/or door screens are missing, defective or in a state of
disrepair. Provide proper window and door screens for all openable
windows and doors. Screens must be tight-fitting and securely fastened
to the frames.
4. The windows and/or storm windows are in a state of disrepair. Replace
all missing or broken window glass. Make all necessary repairs to
frames, sashes, hardwaze and associated trim in a professional manner.
Permit may be required.
5. Unapproved flaslung for roof covering; open to elements.
6. 30 amp electrical service; hazardous height over deck from pole to
house and from house to gazage.
7. The steps for deck lack handrails.
8. The gutters haue missing pieces, drain onto shucture.
9. The house and gazage have chipped/peeled paint.
10. The structure is a registered vacant building and must have a Code
Compliance Certificate before the structure may be occupied.
Immediately vacate the structure or obtain a Code Compliance
Certificate from L.I.E.P. You may contact Jim Seeger at L.I.E.P. for
code compliance inspection, permits, and issuance of Code Compliance
Certificate. Under Chapter 33.03 of the Saint Paul Legislative Code,
failure to obtain a Code Compliance Certificate or to vacate the
structure may result in issuance of criminal summonses.
As owner, agent or responsible party, you are hereby notified that if these deficiencies and
the resulting nuisance condition is not conected by July 13, 2007 the Department of
Safety and Inspections, Division of Code Enforcement, will begin a substantial abatement
process to demolish and remove the building(s). The costs of this action, including
administrative costs and demolition costs will be assessed against the property taxes as a
special assessment in accordance with law.

As first remedial action, a Code Compliance Inspection Report must be obtained from the
Building Inspection and Design Section, 8 Fourth Street, Suite #200, Commerce Building,
(651)266-9090. This inspection will identify specific defects, necessary repairs and legal
requirements to correct this nuisance condition.
As an owner or responsible party, you are required by law to provide full and complete
disclosure of this "Order to Abate" to all interested parties, all present or subsequent
renters and any subsequent owners. If you sell, h or convey in any manner, the
ownership or responsibility for this property, you must within seven (7) days, notify the
Enforcement Officer with the names and addresses of any new owners or responsible
parties.
The Enforcement Officer is required by law to post a placazd on this property which
declazes it to be a"nuisance condition", subject to demolition and removal by the City.
This placard shall not be removed without the written authority of the Department of
Safety and Inspecrions, Division of Code Enforcement. The deparhnent is further
required to file a copy of this "Order to Abate" with the City Clerk's Office.
If corrective action is not taken within the time specified in this order, the Enforcement
Officer will notify the City Council that abatement action is necessary. The City Clerk
will then schedule dates for Public Hearings before the City Council at which time
testimony will be heard from interested parties. After this hearing the City Council will
adopt a resolution stating what action if any, it deems appropriate.
If the resolution calls for abatement action the Council may either order the City to take
the abatement action or fix a time within which this nuisance must be abated in
accordance with the provisions of Chapter 33 of the Saint Paul Legislative Code and
provide that if corrective action is not taken within the specified time, the City shall abate
this nuisance. The costs of this action, including administrative costs will be assessed
against the property as a special assessment in accordance with law.

BUILDING
L Install joist hanger nails in deck joist hangers.
2. Install handrail and guard raii on deck to code.
3. Install landing at base of deck stairs (both).
4. Raise up post at comer of basement stans and install plinth block underneath.
5. Install handrail and guard rail on basement stairs to code.
6. Replace a11 damaged siding or replace to code.
7. Insure all fasteners are triple dipped zinc or zemax coated or stainless on deck.
8. Insure basement cellaz floor is even, is cleanable, and all holes are filled.
9. Install hand and guardrails on all stairways and steps as per attachment.
10. Strap or support top of stair stringers.
11. Tuck Point interior/exterior foundation.
12. Provide thumb type dead bolts for all entry doors. Remove any surFace bolts.
13. Repair or replace any deteriorated window sash, broken glass, sash holders, re-putty etc. as
necessary.
14. Provide complete storms and screens, and repair all door and window openings.
15. Repair walls and ceilings throughout, as necessary.
16. Prepaze and paint interior and exterior as necessary (take the necessary precautions if lead

17. Habitable rooms with new usage, replaced windows shall have glass area equal to 8% of
floor area, or a minimum of 8 sq. ft., one-half of which shall operate and all bedroom
windows shall meet emergency egress requirements (20" wide minnnum, 24" high minimum
but not less than 5.7 sq. ft. overall).

HEATING

6. Ordering the owner to remove or repair the building(s} af 835 Juno Avenue within fi$een (15)
days from adoption of resolution.
Mr. Ma�er stated the building was a one-story, wood &ame, single-family dwelling with a detached
one-stall garage on a loY of 4,792 square feet and had been vacant since November 17, 2006. A code
compliance inspection had been done on December 18, 2006. The vacant building registration fees
were cunent and the $5,000 performance bond had been posted August 8, 2007. On 7une 25, 2007, an
inspecrion of the building was done and a list of deficiencies which consritute a nuisance condition was
developed. An order to abate a nuisance building was posted on July 13, 2007 with a compliance date
of August 13, 2007. To date, the property remained in a condifion which comprised a nuisance as
defined by the Legislative Code. Ramsey County Tasation estimaYed the market value of the land to
be approximately $45,000 and the building to be $75,300. Real estate tases for were current, Code
Enforcement estimates the cost to repair the building to be $50,000. The cost for demolition was
estimated to be approximately $12,000 to $15,000. There had also been four sutmnary abatements
issued to this property since 2006, none of which went to work order. Code Enforcement recommends
the building be repaired or removed within 15 days. Mr. Magner presented photographs of the
property.
Ms. Moermond asked how they became aware this was a vacant building. Mr. Magner stated they
became awaze that there was 30 amp electrical service which was refenred by the housing inspecfor on
a conection notice that had not been completed. At time, the building was vacant and secured and
there were also some other violations including graffiti. The building at that time was placarded as a
vacant building.
Scott Jennings, representing Sunrise Prop Twin Cities Inc., appeared. Mr. Jennings stated that he
intended to make the repairs to the building. His dilemma had been that at the time he posted the bond,
a family member became critically ill and he was responsible for his care. He indicated that he worked
for a plumbing contractor and he had relationships with other contractors who were licensed to work in
St. Paul. He requested he be given six months to complete the repairs from the time that he had posted
the bond. He had attempted to sell the building "as is' ; however, had been unsuccessful in doing so.
He then decided he would rehab the building and then attempt to sell it.
Ms. Moermond stated that it appeared Mr. Jennings kept the property in good condition as far as
exterior maintenance; he had completed the code compliance inspection, and had posted the bond.
What she would require is a work plan with timelines on completing the work. She explained that
since he had posted the bond on August 8 and if he had not completed all of the work by February,
2008, Mr. 7ennings could request an additional six months from Licensing to complete the rehab.
Ms. Moermond stated that since Mr. Jennings indicated that he was a licensed contracfor, he would
need to outline the value of whatever work he may do in rehabilitating the building. The City
estimated that the cost to rehabilitate the property to be $50,000 and he would need to demonstrate the
equivalent value of his work. Ms. Moermond also stated that Mr. Jennings would need to demonstrate
that he had the financial capacity to do the work. This could be in the form of a construcrion loan, a
line of credit from a bank or a balance in a bank account that would be dedicated to this project,
Ms. Moermond stated that she would require the following be submitted by Friday, November 2: 1) az
approved work plan inciuding timelines for completing the wark; and 2) financial documentation
demonstrating fhe ability to afford the rehabilitation. Ma Moermond also noted that the property must
be maintained as part of her conditions.
