This property is legally described as follows, to wit: CLARKE'S ADDITION TO THE CITY OF ST. PAUL LOT 27 BLK 2 WHEREAS, based upon the records in the Ramsey County Recorder's Office and information obtained by Department of Safety and Inspections on or before March 31, 2007, the following are the now known interested or responsible parties for the Subject Property: Sunrise Prop Twin Cities Inc., 801 l St East, Hastings MN 55033-1333; Gemini Equity Crroup LLC, 3141 Dean Court Room #303, Minneapolis, MN 55416; West Seventh/Fort Road Federation, bettvC�a.fo rtroadfed eration.orp WHEREAS, Deparhnent of Safety and Inspections has served in accordance with the provisions of Chapter 45 of the Saint Paul Legislative Code an arder idenfified as an "Order to Abate Nuisance Building(s)" dated July 13, 2007; and WHEREAS, this order informed the then known interested or responsible parties that the structure located on the Subject Property is a nuisance building(s) pursuant to Chapter 45; and WHEREAS, this order informed the interested or responsible parties that they must repair or demolish the structure located on the Subject Property by July 13, 2007; and WHEREAS, the enforcement officer has posted a placard on the Subject Property declaring this building(s) to constitute a nuisance condition; subject to demolition; and WHEREAS, this nuisance condition has not been corrected and Department of Safety and Inspecrions requested that the City Clerk schedule public hearings before the Legislative Hearing Officer of the City Council and the Saint Paul City Council; and WHEREAS, the interested and responsible parties have been served notice in accordance with the provisions of Chapter 45 of the Saint Paul Legslative Code, of the rime, date, place and purpose of the public hearings; and WHEREAS, a hearing was held before the Legislarive Hearing Officer of the Saint Paul City Council on Tuesday, October 9, 2007 to hear tesrimony and evidence, and after receiving testimony and evidence, made the recommendation to approve the request to order the interested or responsible parties to make the Subject Property safe and not detrimental to the public peace, health, safety and welfare and remove its blighting influence on the community by rehabilitating this structure in accardance with all applicable codes and ordinances, or in the alternative by D� - 1�� 2 44 45 46 47 48 49 50 51 52 53 54 55 56 57 58 59 60 61 62 63 64 65 66 67 68 69 70 71 72 73 74 75 76 77 78 79 80 81 82 83 84 85 86 87 88 89 90 91 92 demolishing and removing the structure in accordance with all applicable codes and ordinances. The rehabilitation or demolirion of the structure to be completed within fifteen (15) days after the date of the Council Hearing; and WHEREAS, a hearing was held before the Saint Paul City Council on Wednesday, November 7, 2007 and the testimony and evidence including the action taken by the Legislative Hearing Officer was considered by the Council; now therefore BE IT RESOLVED, that based upon the testimony and evidence presented at the above referenced public hearings, the Saint Paul City Council hereby adopts the following Findings and Order concerning the Subject Property at 835 JiTNO AVENUE. That the Subject Properry comprises a nuisance condirion as defined in Saint Paul Legislative Code, Chapter 45. � 3. That the costs of demolition and removal of this building(s) is esrimated to exceed five thousand dollars ($5,000.00). That there now exists and has existed multiple Housing or Building code violations at the Subject Property. 4. That an Order to Abate Nuisance Building(s) was sent to the then known responsible parties to correct the deficiencies or to demolish and remove the building(s). 5. � That the deficiencies causing this nuisance condition have not been corrected. That Department of Safety and Inspections has posted a placard on the Subject Property which declares it to be a nuisance condition subject to demolition. That this building has been routinely monitored by Department of Safety and Inspections, Vacant/Nuisance Buildings. 8. That the known interested parties and owners are as previously stated in this resolution and that the notification requirements of Chapter 45 have been fulfilled. ORDER The Saint Paul City Council hereby makes the following order: The above referenced interested or responsible parties shall make the Subject Property safe and not detrimental to the public peace, health, safety and welfare and remove its blighting influence on the community by rehabilitating this structure and correcting all deficiencies as prescribed in the above referenced Order to Abate Nuisance Building(s) in accordance with all applicable codes and ordinances, or in the altemative by demolishing and removing the structure in accordance with all applicable codes and ordinances. If the above corrective action is not completed within this period of time Department of Safety and Inspections is hereby authorized to take whatever steps aze necessary to demolish and remove this structure, fill the site and charge the costs incurred against the Subject Property pursuant to the provisions of Chapter 45 of the Saint Paul Legislative Code. 99 3. 100 101 102 103 104 105 4. 106 In the event the building is to be demolished and removed by the City of Saint Paul, all personal property or fixtures of any kind which interfere with the demolition and removal shall be removed from the property by the responsible parties by the end of this time period. If all personal property is not removed, it shall be considered to be abandoned and the City of Saint Paul shall remove and dispose of such property as provided by law. According to our files, it has been a vacant building since November 17, 2006. The current property owner is Sunrise Prop Twin Cities Inc, per AMANDA and Ramsey County property records. There have been four (4) SUMMARY ABATEMENT NOTICES since 2006. There have been zero (0) WORK ORDERS issued. On 7une 25, 2007, an inspection of the building was conducted, a list of deficiencies which constitute a nuisance condition was developed and photographs were taken. An ORDER TO ABATE A NLTISANCE BUILDING was posted on 7uly 13, 2007 with a compliance date of August 13, 2007. As of this date this property remains in a condition which comprises a nuisance as defined by the legislative code. The Vacant Building registration fees are paid. Taxation has placed an estimated market value of $45,000 on the land and $75,300 on the building. As of December 18, 2006 a Code Compliance inspection has been completed. Provide proper window and door screens for all openable windows and doors. Screens must be tight-fitting and securely fastened to the frames. 4. The windows and/or storm windows are in a state of disrepair. Replace all missing or broken window glass. Make all necessary repairs to frames, sashes, hardwaze and associated trim in a professional manner. Permit may be required. 5. Unapproved flaslung for roof covering; open to elements. 6. 30 amp electrical service; hazardous height over deck from pole to house and from house to gazage. 7. The steps for deck lack handrails. 8. The structure is a registered vacant building and must have a Code Compliance Certificate before the structure may be occupied. Immediately vacate the structure or obtain a Code Compliance Certificate from L.I.E.P. Basement: 1. W ater heater is not fired and not in service. 2. Water heater has no gas shutoff, and gas piping and water piping are incorrect. 3. Raise water meter from pit. 4. Repair or replace a11 corroded, broken or leaking water piping. 5. Pipe sizing is inconect. 6. Replace corroded gas piping. 7. Soil and waste piping has no front sewer cleanout or no soil stack base cleanout. 8. Soil and waste piping has improper pipe supports. 9. Replace all corroded waste pipes. 10. Most of the roof covering could not be properly inspected from grade. Recommend this be done before rehabilitation is attempted. There was considerable storage/clutter within property at the time of the inspection. Mr. Ma�er stated the building was a one-story, wood &ame, single-family dwelling with a detached one-stall garage on a loY of 4,792 square feet and had been vacant since November 17, 2006. A code compliance inspection had been done on December 18, 2006. The vacant building registration fees were cunent and the $5,000 performance bond had been posted August 8, 2007. On 7une 25, 2007, an inspecrion of the building was done and a list of deficiencies which consritute a nuisance condition was developed. An order to abate a nuisance building was posted on July 13, 2007 with a compliance date of August 13, 2007. To date, the property remained in a condifion which comprised a nuisance as defined by the Legislative Code. Ramsey County Tasation estimaYed the market value of the land to be approximately $45,000 and the building to be $75,300. Real estate tases for were current, Code Enforcement estimates the cost to repair the building to be $50,000. The cost for demolition was estimated to be approximately $12,000 to $15,000. There had also been four sutmnary abatements issued to this property since 2006, none of which went to work order. Code Enforcement recommends the building be repaired or removed within 15 days. Mr. Magner presented photographs of the property. Ms. Moermond asked how they became aware this was a vacant building. Mr. Magner stated they became awaze that there was 30 amp electrical service which was refenred by the housing inspecfor on a conection notice that had not been completed. At time, the building was vacant and secured and there were also some other violations including graffiti. The building at that time was placarded as a vacant building. Scott Jennings, representing Sunrise Prop Twin Cities Inc., appeared. Mr. Jennings stated that he intended to make the repairs to the building. His dilemma had been that at the time he posted the bond, a family member became critically ill and he was responsible for his care. He indicated that he worked for a plumbing contractor and he had relationships with other contractors who were licensed to work in St. Paul. He requested he be given six months to complete the repairs from the time that he had posted the bond. He had attempted to sell the building "as is' ; however, had been unsuccessful in doing so. He then decided he would rehab the building and then attempt to sell it. Ms. Moermond stated that it appeared Mr. Jennings kept the property in good condition as far as exterior maintenance; he had completed the code compliance inspection, and had posted the bond. What she would require is a work plan with timelines on completing the work. She explained that since he had posted the bond on August 8 and if he had not completed all of the work by February, 2008, Mr. 7ennings could request an additional six months from Licensing to complete the rehab. Ms. Moermond stated that since Mr. Jennings indicated that he was a licensed contracfor, he would need to outline the value of whatever work he may do in rehabilitating the building. The City estimated that the cost to rehabilitate the property to be $50,000 and he would need to demonstrate the equivalent value of his work. Ms. Moermond also stated that Mr. Jennings would need to demonstrate that he had the financial capacity to do the work. This could be in the form of a construcrion loan, a line of credit from a bank or a balance in a bank account that would be dedicated to this project, Ms. Moermond stated that she would require the following be submitted by Friday, November 2: 1) az approved work plan inciuding timelines for completing the wark; and 2) financial documentation demonstrating fhe ability to afford the rehabilitation. Ma Moermond also noted that the property must be maintained as part of her conditions.
