That the Subject Property comprises a nuisance condition as defined in Saint Paul Legislative Code, Chapter 45. 2. That the costs of demolition and removal of this building(s) is estimated to exceed five thousand dollars ($5,000.00). That there now exists and has existed multiple Housing or Building code violations at tkte Subject Property. 4. That an Order to Abate Nuisance Building(s) was sent to the then known responsible parties to correct the deficiencies or to demolish and remove the building(s). 5. Tn the event the building is to be demolished and removed by the City of Saint Paul, all personal property or fixtures of any kind which interfere with the demolition and removal shall be removed from the property by the responsible parties by the end of this rime period. If all personal property is not removed, it shall be considered to be abandoned and the City of Saint Paul shall remove and dispose of such property as provided by law. 4. It is further ordered, that a copy of this resolution be mailed to the owners and interested parties in accordance with Chapter 45 of the Saint Paul Legislative Code. According to our files, it has been a vacant building since August 7, 2006. The current property owner is US Bank N.A., c/o Wells Fargo Foreclosure, per AMANDA and Ramsey County property records. The City of St. Paul has boarded this building to secure it from trespass. There have been nine (9) SUMMARY ABATEMENT NOTICES since 2006. Tlus property is designated by the Vacant Buildings Department as a Categary #3 which requires a$5,000 Performance Bond or Deposit at the time the permit is issued. Provide plans and specifications for any portion of the building that is to be rebuilt. Roof, sidewalks, etc. snow covered and could not be inspected. All must meet appropriate codes when completed. There was considerable storage/clutter within property at the time of the inspection. Property is to meet appropriate Codes when complete. All items noted as recommended do not have to be completed for code compliance but shouid be completed at a later date. The Enforcement Officer is required by law to post a placard on this property which declares it to be a"nuisance condition", subject to demoliYion and removai by the Ciry. This placard shall not be removed without the �vritten authority of the Department of Safety and Inspections, Division of Code En£orcement. The department is further required to file a copy of this "Order to Abate" with the City Clerk's Office. If corrective action is not taken within the time specified in this order, the Enforcement Officer will notify the City Council that abatement action is necessary. The City Clexk wi11 then schedule dates for Public Hearings before the City Council at which time testimony wiil be heard from interested parties. After this hearing the City Council will adopt a resolution stating what action if any, it deems appropriate. If the resolution calls for abatement action the Council may either order the City to take the abatement action or fix a time within which this nuisance must be abated in accordance with the provisions of Chapter 33 of the Saint Paul Legislative Code and provide that if corrective action is not taken within the speeified time, the City shall abate this nuisance. All of this occurred direcfly across the street from North End Elementaty School. On a pleasant Sunday in early December 2005, while many residents were outside decorating their homes for Christmas, our neighborhood came under siege. For 4 hours, the SPPD SWAT Team was in a standoff with a meth addict holed up in 38 East Geranium Avenue; unfortunately, just another day in our neighborhood. The problem did not end when the owner and "friends" eventually vacated the property. After a few weeks of wazm temperatures, a stench emanated from the property, presumably from the garbage, dead dog, fleas, feces, and maggots that police found upon entry. A cleanup crew spent three days shoveling garbage out of the house and garage. They complained to neighbors that the smeil was "unbelievabte." t� fearful immigrant family living next door tried unsuccessfully far two years ta seli their home. Whett they finally just moved away, that house became a rental and has since become another problem property. This is an exxmple of kow a neighborhood spirals into decline. My girlfriend Kara Groth and I moved into 1121 Abell Street two years ago August. In the time we have lived here, the property on 38 Geranium has beea a site for trouble. We have seen traffic at all hours of the night, drugs, shouting, fighting and even witnessed a stand-off with the St. Paul Police. I could hear the caz squealing its tires as iY sped out of sight and raced around the block. As the ^a* r?n *.h.*�ugh the stop sign at Geranium Auenue and Abell Street, it nearly spun auY af contral as the driver attempted a 180-degree turn. As I ran to retrieve my baseball bat in the hope of establishing a greater rapport with the driver, he proceeded to speed away but quickiy ran over tlte curb and sidewalk in front o£ 38 East and smashed the fence before bringing the car to a stop in the back yard of that residence. He then ran imo the house and a 4-hour police/SWAT Team standoff followed. Best Regards, Denis and Jenny Chang 46 E Geranium Avenue October 9, 2007 Legislative Hearing Minutes ��- �oc� j Page 5 Ordering the owner to remove or repair the building(s) at 38 Geranium Avenue East within fifteen (15} days from adoption ofresolution. Mr. Magner stated the building was a one and one-half story, wood frame, single-family dwelling with a detached one and one-half stall garage on a lot of 4,792 square feet and had been vacant since August 7, 2006. A code compliance inspection had been done on 7anuary 30, 2004. The vacant building registration fees were delinquent in the amount of $375 and the $5,000 performance bond had not been posted. On June 27, 2007, an inspection of the building was done and a list of deficiencies which consritute a nuisance condition was developed. An order to abate a nuisance building was posted on July 13, 2007 with a compliance date of August 13, 2007. To date, the properiy remained in a condition which comprised a nuisance as defined by the Legislative Code. Ramsey County Taxation estimated the market value of the land to be approximately $55,600 and the building to be $94,500. Real estate taYes for were current. Code Enfarcement estimates the cost to repair the building to be $60,000. The cost for demolition was estimated to be approximately $10,000 to $12,000. There had also been nine suminary abatements issued to this property since 2006, ten of which went to work order: to secure the building and the City had to board the building to secure it from trespass, remove improperly stored refuse, and remove tall grass. Mr. Magner read into the record letters received from the following on the desire to have the building demolished: Tri Area Block Club; Benjamin O'Grady and Kara Groth; Sheila Sauvageau; John Jungwirth; Kathy Rundquist; a neighbor; Hmong translated letter from Lee and Syda; and Chinese translated letter from Denis and Jenny Chang. Said letters are attached to the minutes and are made a part of this record. Code Enforcement recommends the building be repaired or removed within 15 days. Mr. Magner presented photographs of the property. Mr. Moermond questioned the County's value it placed on the property. Mr. Magner stated the value was unrealistic as parcels currently were not selling for that price, particularly in this neighborhood. Ms. Moermond asked how they became awaze this was a vacant building. Mr. Magner stated that the area inspector received complaints concerning the property and he inspected the property and condemned the building. A vacant building file was opened and when they inspected the property, they found that the water was shut off; there was tall grass and weeds, there was miscellaneous debris; the windows were in need of repair; and the electric was shut of£ Subsequently, they had received many complaints including a complaint that there could be a dog left in the house. They refened the matter to Animal Control and when the supervisor inspected the inside of the house, he did not find a live dog nor a dead dog in the building. The property owner of record, US Bank N.A., c/o Wells Fargo Foreclosure, did not appear. No other parties of interest appeared. Ms. Moermond recommended the building be removed within 15 days with no option for repair.
