RESOLVED, upon the appeal, under the Zoning Code, by Arlo Udstuen,
as owner of the subject real estate in the City of Saint Paul, described as
Lots 16 and 17, Block 3, Auditor's Subdivision No. 7 St. Paul Minn, that
the provisions of the Zoning Code hereby are determined and varied as and
to the extent necessary therefor, and the building setback line in respect
of said real estate and the line at Forest Street on which the same abuts,
shall represent a line 24 feet distant therefrom and parallel to said
line of Forest Street; and that, pursuant to the application of said
Arlo Udstuen therefor, a permit hereby is granted for the installation,
maintenance, and operation on said premises of a 12 -car capacity private
off - street parking facility in conjunction with a 12 -unit apartment
building proposed to be constructed on said premises, all in accordance
with plans approved July 18, 1963, and filed herewith, and subject to
co #Lpliance otherwise with all applicable municipal ordinances, State

This is in the matter of Arlo Udstuenls 1) appeal to establish a 24
foot setback from Forest Street and 2) application for a permit for
a 12 car private off - street parking lot to be constructed on property
located on the east side of Forest and the west side of Duchess Streets
between Sims Avenue and Wells Street which is described as Lots 16, 17,
Block 3, Auditor's Sub. # 7.
This property was. rezoned to t0C" residence on December 22, 1962 as part
of a larger tract. The site is vacant and has a( frontage of 100 feet on
Forest and Duchess Streets with a depth of 132.2 feet between the two
streets resulting in an area of 13,220 square feet. The subject property
has double street frontage and would normally be required to maintain a
26 foot setback from Duchess Street and a 33 foot setback from Forest
Street as established by the existing residences in the block. The surround -
ing area uses are single - family residences. Field investigation discloses
no objection to the requested 24 foot setback from Forest Street as it
appears reasonable and in keeping with the purpose and intent of the Ordi-
nance. The Traffic Engineer has approved the plan which meets the standards
for this type of facility. The proposal meets the required standards for
density and building ground coverage.
In consideration of the above factors, the Board of Zoning recommends
the granting of 1) the appeal to establish a 24 foot setback from Forest
Street and 2) the application for a 12 car private off-street parking
lot in conjunction with a proposed 12 unit apartment building on the
above described property in accordance with plans approved July 18, 1963.
