3 Public VJorks Technical Services, Vacation File Number 06-X-02, the public property hereinafter

the south line of Lot 17 in said Auditor's Subdivision No. 88;
and be it further
RESOLVED that, subject to the herein stated exceptions and with the accompanying Certificazes
of Intended Non-Use, filed voluntarily on behalf of: District Energy/District Cooling St. Paul,
a private, non-profit Minnesota corporation; Saint Paul Regional Water Services, a
municipal corporarion; Northern States Power Company d/b/a Xcel Energy (gas); City of
Saint Paul, a municipality, Public Works Department; made a part hereof by this reference
and filed in the office of the City Clerk of Saint Paul, the City, for itself and on behalf of these
corporations and departrnents, waives the right to the alley right-of-way and utility easements in
the area to be vacated, described above and subject to the following, including:
This vacation shall be subject to the terms and condition of Chapter 130, codified March 1, 1981,
of the Saint Paul Legislative Code as amended, and to the foliowing conditions:
1. That the pefitioners, their successors and assigns shall pay $600.00 as an admnristrative
fee for this vaca6on which is due and payable within 60 days of the effective date of this
resolution.
2. That the pefi6oner is directed by the City of Saint Paul PED—Zoning Department to
apply for and be granted a variance, pertaining to deadend alleys, of statues 69.502(a) and
69.502(c), Sea 69.703 of the City Legisiative Code for variance of Chapter 69
Subdivision Regulations.
3. That an easement shall be retained on behalf of Northern States Power Company dba Xcel
(Electric), a Minnesota Corporation, for its existing facilities and any maintenance of
same. The petitioner or its successor shail provide new easements if required and the

petirioner or its successor sha11 assume a11 costs of relocating facilities to the new
easements.
4. That an easement shall be retained on behalf of Camcast Cable Communications, Inc., for
its existing overhead facilities and any maintenance of same. The petitioner or its
successor shall provide new easements if required and the petitioner or its successor shall
assume all costs of relocating facilities to the new easements.
5. That an easement shall be retained on behalf of Qwest Corporation for its existing
overhead faciliries and any maintenance of same. The petitioner or its successor shall
provide new easements if required and the petitioner or its successor shall assume all costs
of relocating facilities to the new easements.
6. That the petitioners, their successors and assigns shall, within 60 days of the effective date
of this resolurion, file with Public Works, City Real Estate, an acceptance in writing of the
conditions of this resolution and shall, within the period specified in the terms and
condi6ons of this resolufion, comply in all respects with these terms and conditions.

This proposed alley vacation does not conform to the requirements of § 69.502(c) of the
City Legislative Code, which generally prohibits dead-end alleys. § 69.502(c) allows
dead-end alleys only if they are provided with adequate turnaround facilities, something
that is not proposed and appears to be impracfical in this case.
§ 69.502(a) of the Legislative Code requires that alleys be provided where topography
renders driveways from the street to service ar off-street parking areas impractical, which
is the case on this block. A115 houses on the east side of the alley south of Lot 17 depend
on the alley for required off-street parking/garage access and needed service access;
because of a steep 10-foot high slope up to these lots from Montcalm Place, driveways to
these houses from Montcalm Place would be impractical.
If the applicant wishes to pursue vacation of a portion of this alley in variance with the
requirements of § 69.502(a) and § 69.502(c), Sec. 69.703 of the City Legislative Code
provides for filing an appiication far variance of Chapter 69 Subdivision Regulations with
the planning administrator in our office.

I have a feeliog that 1330 Edcumbe will probably end up using part of the curb cut and dnveway on Moncalm`s part of the vacated
alley. If I was the owner of 1330 Edgcumbe I wouid like to see some easements to make that Iegai. But maybe that is behveen
the two property owners. I am not even sure if the Gty wn make getting easements a condition of tfie variance. (I suppc�se we
coufd su9gest it.)
So having said all that: DSI has no ob}ections to the proposed alley vaotlon.

I do have a survey that shows where the property lines and existing drives and curb cuts are located. 1330 would have plenty of
room within the area that accrues to them to use their driveway and garage exactly as they do now, only legally! However, I
understand your concems. IYs not our intent to "squeeze" anyone who currenUy uses the alley. 1330 is one of the signers of the
petit�on reque5t & they understand where the "lines" will be.

I assume that half the vacated alley goes to the property on Mont Calm and the other haif goes to 1330 Edgcumbe. But I am not
sure if 1330 would be able to acCess their garage on their half of the vacated alley without going onto the Montcalm property. That
makes me think there needs to be an easement.

Hi Tom,
The situation is the house at 1330 Edgcumbe does encroach with both a driveway and a retaining wall. They do not have an
encroachment permit. The so{ution at this point is a vacation of the alley w the ROW that indudes encroachments becomes private
property. What would accrue to 1330 Edgcumbe fixes their encroachment problem. No easement would be needed. Does that

I am not recommending approval at this point - but maybe I can be persuaded.
It appears from the aerial photos that the house at 1330 Edgcumbe (behind the Goddard's property) has a driveway to a garage fn
their back yard and that driveway is in fhe area to be vacaYed. So I would not have any objections to the vacation if there is some
kind of easement or other arrangement to ensure that 1330 Edgcumbe can get to their garage.
(Also, there is also a small building in the backyard of 1330 Edgcumbe. It i5 close to the existing property line and I am assuming
that it will be entirely on their property when the vacation is finished. I don't think this is a problem but I am not 100% sure.)

We are herewith submitting a Petition to Vacate the City's interest in a portion of Lot 10,
Auditor's Subdivision No. 88. Attached to the Petition is a plat map showing the lands to be
vacated. We have also enclosed a check payable to the City in the amount of $100.00 in
payment of the application fee.
We have also included an Ownership Report prepared by Old Republic National Title Insurance
Company. The Report indicates that all of the relevant properties are tonens title.
Please keep as advised from time to rime as to the status of this Petition.

said Subdivision;

vacated strip.

The subject strip of land was designed for alley purposes but has not
been opened for that use and there will not be cause to open it at
any future time. The adjoining owners do not intend to build on the
strip.
