RESOLVED, upon the pertinent appeal,under the Zoning Code, by Shell
Oil Company, as owner of the subject premises „situate in the City of Saint Paul
and described as Lots 5, 6, 7, Block 2, American Building Company Plat 3,
at the northeast corner of Lexington Parkway and St. Anthony Avenue, and con-
stituting a single plot in a single ownership and zoned partially in "B”
Residence District and partially in Commercial District under said Zoning
Code, that the provisions of said Zoning Code hereby are determined and
varied as and to the extent necessary therefor and that a p6tmit be and hereby
is granted for the extension of Commercial District use now affecting a part

Dear Madam:
This is in the matter of the Shell Oil Company's 1) appeal for an
extension of commercial use to extend to the entire site, and 2) an
application for a permit to install and operate a new filling station
on property located at the northeast corner of Lexington Parkway and
St.Anthony Avenue which is described as Lots 5, 6, 7, Block 2, Ameri-
can Building Company Plat # 3. The westerly 100 feet of the site is
zoned commercial and has been since the adoption of the Zoning Ordinance
in 1922, the balance of the site is zoned "B" residence.
All of the details of this matter were outlined in a letter dated
July 24, 1963 which letter was read at the Council meeting on July 25,
1963. At'said meeting the City Council denied the appeal and appli-
cation. On July 26, 1963, the Council granted the request of the
Shell Oil Company for permission to withdraw both matters. On August 9,
1963, this matter was again filed and referred to the Board of Zoning
for consideration.
On August 15, 1963, the Board of Zoning again considered the matter,
and recommends the granting of 1) the appeal to extend the commercial
use to the entire site, and 2) the application for a permit to install
and operate a new filling station on the site which is described as
Lots 5, 6, 7, Block 2, American Building Company Plat # 3 in accord-
ance with plans approved Augsut 15, 1963.

Since your favorable decision to my letter of July 17
concerning the use of the three lots adjoining our playground
on the northeast corner of Lexington Parkway and St. Anthony
Avenue$ I have received additional information which, in all
fairness to the Shell Oil Company, should have been used by
me in making my previous request. For one thing, I find that
St. Anthony Avenue which is now closed to traffic will be
opened for one -way traffic to Lexington from the Freeway.
This invalidates one of my arguments in my July 17 letter.
Also, I find that city specifications to be followed by filling
stations adjoining residential property do make a very definite
attempt to safeguard privacy and beauty of adjoining property.
This again nullifies the presumption which I previously had
concerning the detrimental influence of a filling station in
our immediate area. I further feel now that the fence which
encloses our playground and the additional fence which will
surround the filling station will sufficiently protect the
children of the area.
All in all, therefore, I find that with the additional
information that has come to me since the case was presented
to you on July 25 does not substantiate my attitude at that
writing so,.with your permission, I beg to withdraw my previous
objections to the contemplated use of the above property. May
I thank you again for the confidence which you have shown me
in the past and especially in your decision of July 25. I
really felt that I had the welfare of the neighborhood and
especially our school children in mind in the previous wkting
but additional information has proven otherwise.

I have been informed of the request which you gentlemen
have received concerning the three lots on the northeast corner
of Lexington Parkway and St. Anthony Avenue. Since this property
is immediately adjacent to the playground of St. Peter Claver
School and is a part of the block housing the entire Church plant,
I am vitally interested in whatever disposition will be made of
them. The use made of that property will have a direct bearing
on our property which is approximately two - thirds of the entire
block. Since acquiring the 18 lots in this block we have
invested about $650,000 in buildings and improvements. There is
no question that this has reflected to the betterment of the area
generally, as seen by the,type of housing since attracted to our
neighborhood. We need not tax our imagination too severely to
realize what effect a service station would have on our area.
My concern, however, is not principally a matter of
property values. We are established as a Church and School, and
regardless of whether our property skyrockets or slumps in value
we will continue to operate where we are. We have no intention
of moving. Of far greater concern to me are the hazards which
would be created by the existence of a filling station immediately
adjacent to school property. Our playground property is entirely
fenced in, but that can control youngsters only during recess
periods on school time. It will not control them before and after
school hours or during the noon lunch period. I have been happy
since St. Anthony Avenue has been closed off at Lexington. It
has practically stifled traffic from Oxford to Lexington. A
filling station on Lexington will again open this block to traffic.
As of present we are very happy with the five apartment buildings
facing Lexington on the western side of our block. They guarantee
us the peaceful quiet a school needs.
Another thought which keeps coming to me is that a change
of status of the three lots in question is bound to be but a
beginning of a trend which must soon engulf our whole side of
Lexington. I wouldn't blame the other two apartment owners if they,
too, would soon look for a lucrative sale to other business to take
over from them. Further, do we have a need for a filling station
in our area? At the present time we have three super stations just
three short blocks north of us. On the other hand, we do need
housing. you are well aware of the havoc caused in the housing
situation in our area by the Capitol approach and the freeway.

eight units. We can ill afford to lose them.

my request. I am quite certain that I speak for the majority

definitely for the welfare of the 307 children now attending
our school.,

This is in the matter of the Shell Oil Company's 1) appeal for an extension of
commercial use to extend to the entire site, and 2) an application for a permit
to install and o erate a new filling station on property located at the north-
east corner of Li
eNngton Parkway and St. Anthony Avenue which is described as
Lots 5, 6, 7, Block 2, American Building Company Plat # 3. The westerly 100
feet of the site is zoned commercial and has been since the adoption of the
Zoning Ordinance in 1922; the balance of the site is zoned "B" residence.
The subject property is developed with three apartment structures which will be
removed for the proposed development. The property has a frontage of 156 feet
on Lexington Parkway and 120 feet on St. Anthony Avenue resulting in an area of
approximately 16,720 square feet. To the east and across an improved public
alley is the St. Peter Claver parochial school which fronts on St. Anthony
Avenue; to the south and across St. Anthony Avenue is the proposed freeway;
west and across Lexington Parkway is vacant land under the ownership of the
Highway Department; north and adjoining are two apartment buildings. Inasmuch
as a portion of the site is zoned "B" residence, it is required to secure
Council authorization to allow a use permitted on a portion of the tract to
extend to the entire site.
Field investigation discloses no basic objection as the proposed plan meets all
of the standards for this type of facility. The proposed Land Use Plan indi-
cates the highest and best use of this property to be for multi - residential
purposes. The Traffic Engineer has approved the proposed curb cuts on both
Lexington Parkway and St. Anthony Avenue. However, as stated in a letter dated
June 17, 1963 and addressed to Mr. Morgan of the Shell Oil Company, the Traffic
Engineer advised the applicant that if operating problems develop with respect
to the driveway on St. Anthony Avenue, the City reserves the right to close the
entrance.
In consideration of the above factors, the Board of Zoning recommends the
granting of 1) the appeal to extend a use permitted on a portion of the tract to
the entire tract, and 2) the application for a permit to install and operate a
filling station on the above described property subject to the provision as out-
lined above concerning the driveway on St. Anthony Avenue.
