AN ORDINANCE AMENDING ORDINANCE NO. 2 D�1, EN-
TITLED:
"AN ORDINANCE GRANTING PERMISSION AND AU-
THORITY TO THE VILLAGE OF MAPLEWOOD TO CON-
NECT THE PUBLIC SEWER SYSTEM OF SAID VILLAGE
OF MAPLEWOOD TO THE PUBLIC SEWER SYSTEM OF
THE CITY OF SAINT PAUL AND THEREAFTER MAIN-
TAIN AND OPERATE THE SAME AS AN OUTLET FOR
SAID PUBLIC SEWER SYSTEM OF SAID VILLAGE FOR
PUBLIC SEWAGE CONVEYANCE AND DISPOSAL PUR-
POSES, AND PROVIDING_APPLICABLE TERMS AND

APPROVED JULY 269 1957, AS AMENDED. THIS IS
AN EMERGENCY ORDINANCE RENDERED NECESSARY FOR
THE PRESERVATION OF THE PUBLIC PEACE, HEALTH
AND SAFETY.
THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN:
Sect>on 1. That Ordinance No. 110619 approved
July 269 1957, as amended, be and the same is hereby further
amended by inserting therein at the end of the first para-
graph of Section 3 of said ordinance, as amended, the follow-
ing provisions for additional sewer connections for sewer
service to real property situate beyond the corporate limits
of the Village of Maplewoods
"And except that said Village of Maplewood
may permit the installation, maintenance
and operation of sewer service connections
between its said public sewer system and
the following described real property lying
beyond its corporate limits: All that area
lying within the village limits of the Village
of Landfall, County of Washington, State of
Minnesota, as described in the Articles of
Incorporation of Landfall now on file in the
Office of the Secretary of State of the State
of Minnesota, said area consisting of 45 acres
{ more or less; solely for sanitary sewage drain-
age purposes and subject to all provisions,
terms and conditions of this ordinance which
are hereby made applicable thereto, with the
same intent, purpose, and effect as if such
' next above described real property were entirely
situate within the corporate limits of said
Village of Maplewood. That no connection other
than that authorized under Section 1 of this
ordinance directly between the public sewer

system of said City shall.be constructed, main-
tained or operated without further express
authorization therefor by the Council of said
City."
Section 2. That this amendatory ordinance shall
be deemed dependent for its operative effect upon the ac-
ceptance of the same and the concurrence therein by said
Village of Maplewood, evidenced by an ordinance passed by
its Village Council or governing body, which ordinance shall
contain the express proviso that at any future time the
City of Saint Paul sewers to which the Village of Maplewood
connects, become overloaded, the Village of Maplewood will
pay to the City of Saint Paul the total cost of the construc-
tion of whatever additional sewer capacity is needed, in-
cluding costs of easements, street restoration and whatever
other costs are directly associated with said sewer construc-
tion to make said jointly -used sewers in the Battle Creek
sanitary sewer system fully adequate; and further dependent
for its operative effect upon the filing of a certified copy
of the Village's ordinance enacted in compliance herewith
in the office of the City Clerk not later than 60 days next
after the official publication of this amendatory ordinance.
Section 3. This ordinance is hereby declared to
be an emergency ordinance rendered necessary for the preserva-
tion of the public peace, health and safety.
Section 4.' This ordinance shall take effect and
be in force upon its passage, approval and publication.

RESOLUTION NO. 1019

WHEREAS, The Village of Maplewood and the City of Saint Paul have
heretofore, on July'269 19579 entered into a contract for public sewage
conveyances and disposal purposes, under Saint Paul City Ordinance No. 11061,
granting the Village of Maplewood the authority to connect with the Saint
Paul sewer system, and
WHEREAS, The Village of Maplewood desires to permit connection to
the Village of Landfall which the City of Saint Paul has approved by Ordinance
No. 12541 amending Ordinance Now 11061, and
WHEREAS, The City of Saint Paul has requested approval of the Board of
Trustees of the Minneapolis -Saint Paul Sanitary District of said Ordinance
No. 12541 to allow the Village of Landfall to connect with the Village of
Maplewood sewer system,
NOW, THEREFORE, BE IT RESOLVED, That the Board of Trustees
of the Minneapolis -Saint Paul Sanitary District, without
review or investigation of the terms and conditions of the
aforesaid contract except for sewage volumes, does hereby
grant approval to the City of Saint Paul to authorize an
amendment to Ordinance Noe 11061 (being Ordinance No. 12541)
to permit the Village of Maplewood to connect its sewer
system to the Village of Landfall.
