WHEREAS, In'the Matter of the construction of the BATTLE CREEK
SANITARY SEG,TER. SYSTET,I - SOUTH INTERCEPTOR, SECTION I, which
Improvement lies within the Right-of-way limits of Trunk
Highuay No. 61, it is necessary to procure a Public Utility
Permit from the Department of Highways, State of Minnesota, and
WHEREAS, The;,Special Provisions of said Permit require that the
City of St. Paul shall furnish a certified check in the amount
of $5,000.00, to cover any expense incurred in the repairing
of any damages to any portion of said Trunk Hightiay Right -of-
Way, therefore, be it
RESOLVED, That the Commissioner of Public 4lorks be and he is
hereby authorized to issue the necessary Miscellaneous Claim
to the City Comptroller to prepare a certified check in the .
amount of 05,000.00, payable to the Commissioner of Highways,
for any expense incurred for repairs to said Trunk Highway
Right -of -Way, and any portion remaining over and above such
expense, or,.liquidated•damages, shall be returned to the City
of St. Paul, and said amount of 05,000.00 is to be paid from
the Permanent Improvement,Revolving Fund, Code 3001, L -6583,
and any portion remaining to be credited to the above mentioned
fund.
