1 RESOLUTION AUTHORIZING APPLICATION TO THE DEPARTMENT OF EMPLOYMENT AND
2 ECONONIIC DEVELOPMENT FOR CONTAMINATION INVESTIGATION AND CLEANUP GRANTS
3 AND TO THE METROPOLITAN COUNCIL FOR TAX BASE REVITALIZATION GRANTS FOR THE
4 TOTAL TOOL, SHOLOM HOME, 360 CEDAR STREET, AND LANDMARK BREWERY SITES.

6 WHEREAS, the City of Saint Paul, Minnesota is a participant in the Livable Communities AcYs Housing
7 Incentives Program for 2007 as determined by the Metropolitan Council, and is therefore eligibie to make
8 application for funds under its Tu� Base Revitalizarion Account; and

l0 WHEREAS, the City has identified environmental invesligation and clean-up projects within the City that
I1 meet the purposes and criteria of the Contamination Investigation and Cleanup Grant Program of the
12 Department of Employment and Economic Development, and the Tcrx Base Revitalization Account Grant
13 Program of the Metropolitan Council;

15 NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of Saint Paul, Minnesota
16 hereby approves the contamination invesrigation and cleanup grant applications submitted to the
17 Department of Employment and Economic Development and the Metropolitan Council on November 1,
18 2007 by the City of Saint Paul for the Total Tool, Sholom Home, 360 Cedaz Street, and Landmark Brewery sites;

zl BE IT FURTHER RESOLVED, that the City of Saint Paui, Minnesota agrees to act as legal sponsor for
22 the projects contained in the cleanup grant applicarions submitted to DEED and the Met Council on
23 November 1, 2007 and that the Director of the Department of Planning and Economic Development is
24 hereby authorized to apply to DEED and the Met Council for funding of these projects on behalf of the
25 Total Tool, Sholom Home, 360 Cedar Street, and Landmazk Brewery sites; and

27 BE IT F[JRTHER RESOLVED, that the City has the legal authority to apply for financial assistance, and
28 the institutional, managerial and financial capability to ensure adequate project administration; and

3o BE IT FURTHER RESOLVED, that the sources and amounts of the local match idenrified in the
31 applications are committed to the projects idenrified; and

33 BE IT F[JRTHER RESOLVED, the City of Saint Paul certifies that it has not violated any Federal, State
34 or local laws pertaining to fraud, bribery, graft, kickbacks, collusion, conflict of interest, or other unlawful
35 or corrupt pracrice and that it will comply with all applicable laws and regulations as stated in the contract
36 agreements; and

38 BE IT FURTHER RESOLVED that upon approval of its applications by the Department of Employment
39 and Economic Development and the Metropolitan Council the City of Saint Paul may enter into agreements
4o with the State of Minnesota for the above-referenced projects, and that the City of Saint Paul certifies that it
41 will comply with all applicable laws and regulation as stated in all contract agreements;

43 NOW THEREFORE BE IT FINALLY RESOLVED, that the Mayor and City Clerk of the City of Saint
44 Paul aze hereby authorized to execute such agreements as are necessary to implement the pro}ects on behalf
