1 WHEREAS, Xcel Energy, Inc. proposes that the City of Saint Paul Division of Parks and
2 Recreation ("Parks") grant a license to Xcel Energy, Inc. for construction, operation and
3 maintenance of a underground circulating water pipeline for the new natural gas fired combined-
4 cycle plant ("High Bridge P1anY') under across ciry park land abutting Xcel Energy, Inc. property
5 at 501 Shepard Road as shown on ( E�ibit "A") a copy of which is attached hereto and on file in
6 the Department of Public Works, Technical Services Division, File Number 10-2006; and
8 WHEREAS, the City of Saint Paul, Division of Parks and Recreation ("Parks") has given
9 permission to the said properry owner to construct and maintain a underground circulating water
10 pipeline for the new natural gas fired combined-cycle plant under and across said city-owned park
11 land along Samuel H. Morgan Trail, as stated 'm the Saint Paul Parks and Recreation
12 Commission's Resolution Nwnbered 06-13, adopted May 10, 200b, a copy of which is attached
13 hereto;and

15 WHEREAS, said properry owner must enter into an agreement with the City of Saint Paul for the
16 conshuction and continued use of and access to Samuel A. Morgan Trail, and pay just compensation
17 to Pazks as determined by an independent appraisal pursuant to Section 13.011 of the Saint Paul
18 City Charter; now, therefore be it

20 RESOLVED, that the proper City officials are hereby authorized and directed to enter into an
21 agreement with the Xcel Energy, Inc for access to city-owned park land along Samuel H. Morgan
22 Trail; and be it fiu•ther

24 RESOLVED, that just compensation for said access be paid by the owner Xcel Energy, Inc. and
25 deposited into the Pazkland Replacement Fund and held in reserve far future purchase of park
26 property as required in Chapter 13.01.1 of the City Charter, and that any other costs incurred by
27 the City of Saint Paul to complete any agreement, shall be fully compensated by the property
28 owner.

conshuct and maintain a underground ciiculating water pipeline undet and across the Samuel H. Morgan trail (also laiown as Shepazd �
Road). Per City Charter (Ch. 13.01.1) the City may dispose of the property.

RESOLUTION 06-13
WHEREAS, the Saint Paul Pazks and Recrearion Commission is an appointed body established to
advise the Mayor and City Council on long-range and ciry-wide matters related to Pazks and Recrearion;
and
WHEREAS, Secrion 13.011 of the City Charter requires that the Commission review any
diversion or disposal of park property and present a recommendarion to the Saint Paul City Council; and
WHEREAS, Xcel Energy proposes that the City of Saint Paul through its Parks and Recrearion
Division, issue a license to Xcel Energy for the conshucrion, operation and maintenance of a underground
circularing water pipeline for the new natural gas fired combined-cycle plant ("High Bridge P1anY') under
across city pazk land abutting Xcel Bnergy property at 501 Shepazd Road (as shown on attached E�ibit
"A'�; and
WHEREAS, Xcel Energy requests that they be granted a Right-to-Enter Pernrit due to the rimeline
to begin construcrion and complete the natural gas fired combined-cycle plant by the spring of 2008: and
WHEREA5, any existing trails, trees or other landscaping disturbed as a result of the pipeline
construction will be restored at Xcel Energy's expense and in a mauuer acceptable to the Division of Parks
and Recreafion; and
WI�EREAS, the Division of Pazks and Recrearion has determinad that the parkway property may
be diverted for this purpose and recommends Commission support for the request; now, therefore
BE IT RESOLVED, that the Saint Paul Pazks and Recrea6on Commission concurs with the
request to divert city pazk land along Samuel H. Morgan Trail (also lmown as Shepard Road) through a
license to the Xcel Energy at 501 Shepazd Road (High Bridge Plant), and in accordance with City Charter
Secrion 13A1.1 recommends approval by the Saint Paul City Council.
