•` 1. The "said reli&us order shall file with the
City of Saint Paula surety bond in the amount of $1,000,
conditioned to save the City harmless from all claims and
damages of whatsoever kind and nature during the period
when said old walk is being removed 4ni the area sodded,
said bond! to be filed with the City prior to the commence-
ment of the work herein authorized.
,.2. The Order agrees as a condition to the
permission hereby granted that,in case the Public Works
Department receives any substantial number of complaints
due to the removal of said sidewalk or, in the event that
pedestrian traffic in the area increases in the future so
as to necessitate restoration of said public sidewalk, then
in either event, as determined by the Chief Engineer, of';the
City of Saint Paul, said Order at its own cost and expense
will replace and restore said sidewalk, or the City will
replace it in accordance with customary City procedures
and assess the cost of installation of said sidewalk
against the abutting property.
3. The Order agrees as a condition to the
T- - -permission hereby granted that maiit dance of the area as
a sodded,,boulevard is temporary, only and may be revoked
by the Council of the City of Saint Paul at any time by
resolution of said body...
"4. The Order agrees to file with the City Clerk
a letter'signed by a duly authorized official of said Order
agreeing,.to accept all of the terms, conditions and pro-
visions of this resolution, which letter must be filed
within 15 days after the passage of this resolution, other-

WHEREAS, The Reverend Emil Helfrich, of the
Oblates of Mary Immaculate, 15 Montcalm Court, has re-
quested permission from the Public Works Department to
remove approximately 150 feet of sidewalk on Highland
Parkway from the east line of Montcalm Court to a point
approximately 150 feet easterly thereof.

WHEREAS, said sidewalk, a public sidewalk, is
virtually never used for pedestrian travel thereon, and
over the years has reached a point where it probably
should be replaced if it were to be continued in use for
public travel thereon;
.WHEREAS, the aforesaid religious order is de-
sirous at the present time of avoiding the cost of re-
placing said walk which is estimated to be in the sum of
approximately $300, and is willing, therefore, to remove
said walk-'at its own cost and sod the area from which said
walk would be removed; and'
`WHEREAS, the Chief Engineer of the Public Works
a` Department has determined that at the present time it is
`.� unnecessary to replace said segment of the walk;
1 `NOW, THEREFORE, BE IT RESOLVED, That permission
is hereby "granted to the Order of the Oblates of Mary
Immaculate, 15 Montcalm Court, to remove the aforesaid
approximately 150 feet of sidewalk subject to the follow-
ing terms;'and conditions:
