WHEREAS, in the matter of the Widening and Paving of FAIRVIEW
AVENUE from St. Clair Avenue to Summit Avenue, Comptroller's
Contract L- 6440 -A, Ashbach Construction Company, contractor,
the specified date of completion is October 1, 1962, and
WHEREAS; the Contractor has prosecuted the work diligently,
but due to the lateness of the season, the seal coating
operations could not be done satisfactorily, it being provided
in the specifications that seal coat material shall not be
placed before May 15 or after September 15, with the result
that it was not possible to complete the contract by said
date of completion, therefore, be it
RESOLVED, that the proper City Officials be and they are hereby
authorized and directed to execute an amendment to said con-
tract extending the time of completion to JULY 15 1963, pro-
videc?, however, that this resolution shall have no force or
effect unless the sureties on the contractor's bond consent
thereto and file such consent in writing with the City Comp-
troller, and be it
FURTHER- RSOLVE,D, that the City of St. Paul hereby waives all
claim for liquidated damages and that no engineering and
inspection costs on this project will be charged to the Con-
tractor for such extended period.
