owner of the property, pursuant to its application therefor, is hereby granted
a permit for the installation and operation of a 40 -car capacity customer
off - street parking facility and a used car sales lot on the premises located
on the north side of Pleasant Avenue between Kellogg Boulevard and Chestnut
Street, particularly described as Lots 8, 9, and 10, Block 64, Irvine's
Addition, in accordance with plans therefor herewith filed, and subject to
compliance with the provisions of all applicable City ordinances and State
statutes and rules and regulations of public authorities having cognizance.

Dear Madam:
This is in the matter of the application of Young, Inc. for a permit
for a 40 car customer parking lot and a used car sales lot on property
located on the north side of Pleasant Avenue between Kellogg Boulevard
and Chestnut Streets which is described as Lots 8, 9, 10, Block 64,
Irvine's Addition. The property is zoned commercial.
The site is vacant and owned by the Highway Department. It is being
leased by the applicant until 1965 and a copy of the lease is part of
the file. The subject property has a frontage of 172 feet on Pleasant
Avenue and a depth of 151.9 feet, resulting in an area of approximately
26,127 square feet. West across unimproved Chestnut Street is a used
car sales lot; south and across Pleasant Avenue is the Postoffice garage
and parking lot; east and adjoining is the Young automobile agency;
north, at a higher elevation, is the property of the Archdiocese of St.
Paul.
Field investigation discloses no basic objection. The Traffic Engineer
has approved the plan which meets the standards for this type of
facility.
In consideration of the above factors, the Board of Zoning recommends
the granting of the application for a customer parking lot and used
car sales lot on the above described property in accordance with plans
approved May 9, 1963 and dated May 24, 1963.

Gentlemen:
You referred to this office a matter of the resolution granting
to Young, Inc. a permit for-the installation and operation of
a 40 -car customer parking lot and used car sales lot on the
north side of Pleasant Avenue between Kellogg and Chestnut.
The problem seems to be that there is a possibility that some
of these cars may have their brakes released and roll down onto-
the sidewalk. Our investigation indicates that there is a row
of eight inch high concrete curb blocks along the parking lot
about four feet from the sidewalk which are securely anchored
into the ground.. It is the opinion of this office that this is
enough to prevent the cars from rolling out onto the sidewalk.
We also would like to call the Councils attention to the fact
that this property has now been leased to the Hurd Lincoln
Mercury, Inc. and therefore the resolution granting this should
be to the Hurd Lincoln Mercury, Inc. rather than to Young, Inc.
