WHEREAS, the Department of Public Works has received a
request from Hurcon, Inc., a contractor retained by the Minnesota
Highway Department for work in connection with the Interstate
Bridge over Shepard Road, to use City stockpiled dirt to construct
a temporary ramp at the end of Elway Street, the purpose of this
ramp being to provide an access road for hauling 90 foot -long
girders to the bridge site, the City dirt stockpile and the
location of the ramp to be constructed by Hurcon, Inc. shown on
the attached sketch which has been marked Exhibit "A" and in-
corporated herein by reference; and
WHEREAS, the Department of Public Works is agreeable to
permitting Hurcon, Inc. to use such City stockpile upon the
following terms and conditions; now, therefore, be it
RESOLVED, That Hurcon, Inc. is hereby granted a permit to
use City stockpiled dirt located near the vicinity of Elway
Street and Montreal Avenue, as shown on the attached Exhibit "A ",
upon the following terms and conditions:
1. Hurcon, Inc. shall file with the City Clerk a.
letter signed by a duly designated officer of said
company, agreeing to be bound by all of the terms,
conditions and provisions of this resolution;
2. Hurcon, Inc. shall procure either a policy of
insurance protecting the City and Northern States Power
Company from any claims arising by virtue of the work
hereby permitted or an endorsement to its policy of
insurance required by the State, naming the City and
Northern States Power Company as co- insureds thereon,
which policy of insurance or endorsement to the company's
existent policy of insurance shall be satisfactory to
the Corporation Counsel of the City of Saint Paul and
to Northern States Power Company;

3. Hurcon, Inc. shall file with the City of Saint Paul
a bond.in the amount of $1,000.00, to be approved by
the Corporation Counsel, which will guarantee compliance with
the provisions'of this resolution and restoration of the area
to the satisfaction of the Chief Engineer of the City of
Saint Paul;
4. Hurcon, Inc. shall remove the temporary ramp after
the use for hauling bridge girders has been completed;
5. Hurcon,,Inc. shall restore the stockpile ramp dirt
in the area shown on Exhibit "A ";
6. Hurcon, Inc. shall repair any damage caused by it to
Montreal Avenue and Elway Street;
7. Hurcon, Inc. shall cooperate and schedule its work
so as to coordinate with City contractors working in the
area;
8. Hurcon, Inc. shall confer with the City Engineer,
Northern States Power Company officials, and any others
determined by the City Engineer before starting such work;
9. Hurcon, Inc. agrees that it will not block existing
access roads in the area.
