That the Zoning Code, Chapters 60 to 64, inclusive, of the Saint Paul Legislative Code, pertain-. ing to Use Districts, Height Districts, and Rezoning of certain properties in the City of Saint Paul, as amended,.. be and the same is hereby further amended so as to rezone the following described property from "A" Residence District to "C" Residence District, to -wit: The westerly one -half of Lot 3 and all of Lots 4 and 5, Block 4, Granport Addition together with that portion of the vacated alley that accrues to said land, according to the plat thereof on file and of record in the office of the Register of Deeds in and for Ramsey County, Minnesota, being located on the north side of St. Paul Avenue between Edgcumbe Road and Davern Street. Section 2. This ordinance is hereby declared to be an emergency ordinance rendered necessary for the preserva- tion of the public peace, health and safety. Section 3. Shetka et al to rezone from "A" to "C" residence property located on the north side of St. Paul Avenue between Edgcumbe Road and Davern Street which is described as the westerly J of Lot 3 and all of Lots 4 and 5, Block 4, Granport Addition together with that portion of the vacated alley that accrues to said land. On May 13, 1963, the Commissioner of Finance reported the petition suffi- cient with the owners of 8 of a possible 12 (66 2/370) tracts of land within the prescribed 100 foot radius having signed the petition. The pro- perty is vacant and has a frontage of 100 feet on St. Paul Avenue and ex- tends to Morgan Avenue with a depth of 138.84 feet, resulting in an area of approximately 13,884 square feet. As stated on the petition, the proposal is to develop it with an apartment building which would be a continuation of the apartment development recently constructed on the adjoining property to the west. East and adjoining is a large residence which fronts on Davern Street; south and across St. Paul Avenue is the proposed Jewish Community Center; north and across Morgan Avenue are several vacant lots and one single - family residence fronting on Davern Street, all classified in the "A" residence district. Field investigation discloses no basic objection as the reclassification would be a continuation of the 11Ct1 residence zoning to the west and would be compatible with the area uses. The Proposed Land Use Plan indicates the highest and best use of the land is for apartment development. In consideration of the above factors, the Board of Zoning recommends the granting of the petition to rezone the above described property to a "C" residence district. Sincerely, K -C H. C.
