4 WHEREAS, Minnesota Statutes 471.59 et. seg requires the conseflt of the governing bodies of political
5 subdivisions to enter into agreements among them for such matters as employee interchanges; and

7 WIIEI2EAS, the City of Saint Paul and Ramsey County desire to enter into an amendment to agreement

WHEREAS, it is the intent of the Council that the City be reimbursed by Ramsey County for all costs
incurred by the City as a result of the transfer, including salary, fringe benefits and pension costs; and
BE IT RESOLVED, that the proper City officials are authorized to enter into a written agreement
consistent with the above recitals and applicable laws.

The Ramsey County Sheriffs Office has asked the City to participate in an inh�a-govemmental agreement to allow Police Officer
Russell Gazvey to facili[ate canine training to the Ramsey County Sheriffs Office for an additional 12 months effective December 31,
2006. Ramsey County will agree to reimbuTSe the City for all salary, benefits and any related costs associated wih the agreement.

AMENDNIENT TO CONTRACT #02-13850-0
An amendment to Agreement #02-13850-0 is made and entered into this 31�` day of
December 2006, by and between the County of Ramsey acting through its Sheriff s Office
(hereinafter "RCSO") and the CTTY OF SAINT PAUL, hereinafter called °CITY".
In consideration of the mutual terms and conditions, promises, covenants, and payments
hereinafter set forth, RCSO and CITY agree to aznend the above mentioned agreement pursuant
to pazagraph one as follows:
Effective December 31, 2006, this assignment is extendeti for an addifional 12 months.
RCSO and CITY agree to abide by all of the terms and conditions of the original Agreement.
IN WITI3ESS WHEREOF, the parties hereto haue executed this amendment to
Agreement #02-13850-0, the day and year first above written.

AGREEMENT
BETWEEN
RAMSEY COTJNTY, RAMSEY COUNTY SHERIFF'S OFFICE
AND
CITY OF SATNT PAUL, POLICE DEPARTMENT
T'his intergovernmental mobility agreement (Agreement) is hereby entered into effective the
day of , 2006, by and between the County of Ramsey acting through its Sheriff's
Office (hereinafter "RCSO") and the City of Saint Paul, Police Department (hereinafter
"City").
WHEREAS, Russ Garvey is a regular employee of the City, in the position of Police Officer
with certain rights as a City employee; and
WHEREAS, the parties agree that Russ Garvey be granted an intergovernmental mobility
assignment from the City to the Ramsey County Sheriff's Office to assume the duties
described; and
WHEREAS, this agreement is authorized by and subject to Minnesota Statutes 15.51 —
15.59 (inclusive);
NOW THEREFORE, the parties hereto and their respective agencies hereby agree as
follows:
1. Effective March 4, 200b, or as soon thereafter as approved by the parties hereto,
Russ Garvey will be placed on an intergovemmental mobility assignment from the
City to the RCSO for an initial periad of 10 months, March 4, 2006, through
December 31, 2006. This assignment may be extended for an add'ational 12 months
2. Under direction of Sheriff Bob Fletcher, Russ Garvey will facilitate canine training
for the Sheriffl s Office.
3. As Russ Garvey serves at the pleasure of the Sheriff, this Agreement may be
terminated without notice at any time by the Sheriff. The Agreement may also be
terminated at any time by Russ Garvey or the City with 30 days written notice.
4. The RCSO shall reimburse Russ Garvey for all expenses incuned which relate to his
duties in the Felony Apprehension unit, pursuant and subject to the applicable
expense reimbursement policies of the RCSO.
5. For the duration of this Agreement, Russ Garvey remains a regular employee of the
City and continues to accrue and retain benefits, seniority, compensarion and
allowances from the City in accordance with any current and subsequently approved
City administrative procedures and/or policies and labor agreements, including any

increases in compensation or allowance that may occur during the effective dates of
this mobility agreement for which Russ Garvey could be eligible. Russ Garvey will
comply with all City procedures related to receipt of ailowances or use of
sickivacafion time. Tota1 compensation under this Agreement for Russ Garvey's
services shall be as reflected in the current or fixture labor agreement between the City
of Saint Paul and the Saint Paul Police Federation and will include the cost of all
fringe benefits or overtime as identified in the labor agreement.
6. All of Russ Garvey's compensation will be subject to the Police and Fire Plan of the
Public Employee Rerirement Association of Minnesota with regulaz conh
from the City and Russ Garvey.
7. Russ Garvey will remain an active licensed peace officer on the City roster subject to
Peace Officers Standards and Training Board ("POST") continuing education
requirements. Russ Garvey may attend in-service training provided by either the City
of the RCSO at his option, but is required to keep his POST license cusrent.
8. During the term of this Agreement, the RCSO shall, upon receipt of invoice in proper
form, reimburse the City quarterly, or as otherwise agreed, for all compensation and
related fringe benefits costs, as outlined or as subsequently incteased, paid to or on
behalf of Russ Garvey from the City as described in Paragraphs 5 and 6 above, except
for training or uniform allowances.
9. Each party is responsible for its own acts and conduct and the results thereof. Each
party's liability is governed by the Municipal Tort Claims Act, Minnesota Statutes
466.02. Althou� the supervision of Russ Garvey's duties will rest exclusively with
the RCSO, it is agreed that he is not a RCSO employee and is not entitled to any
benefits from Ramsey County or the RCSO, including but not limited to,
unemployment benefits, pension, sick and vacarion leave, death and medical benefits
except as provided in Minn. Stat. 15.54, Subd. 3
10. Nothing in this Agreement, express or implied, is or shall be construed to be an offer
or promise or permanent or other employmenC for Russ Garvey with Ramsey County
ar the RCSO. �
1 l. Mr. Russ Garvey retains the right to return to his regular employment with the City
upon expiration of the mobility assigrunent or due to termination of this assignment at
any Cime during the effective dates of this Agreement.
