FURTHER RESOLVED, That the use of said property
by said Board of Water Commissioners shall be a joint use with
the Department of Public Utilities of said tract or parcel in
connection with the operation of the City Market; provided,
however, that hereafter no building or structure shall be
erected on said tract or parcel so as to interfere with the
use of said tractor parcel by the Board of Water Commissioners
for waterworks purposes.

WHEREAS, the Board of Water Commissioners, in
cooperation with the State of Minnesota, Department of Highways,
and in order to facilitate State Highway Project No. 6280 -89 is
confronted with the necessity of relocating a principal feeder water
main; and
WHEREAS, such relocation necessitates use of a portion of
the property belonging to the City of Saint Paul now being used as
the City Market; and
WHEREAS, the Board of Water Commissioners heretofore on
June 18, 1963, proposed to request of the Department "of.Public
Utilities and the Council of the City of Saint Paul that the tract
or parcel hereinafter described be made available for use by the
Board of Water Commissioners in connection with the installation,
maintenance, use, and operation of a principal feeder main through
said tract or parcel; and
WHEREAS, the Department of Public Utilities recommends
to the Council of the City of Saint Paul that the Board of Water
Commissioners be granted the use of the aforesaid tract or parcel
for its purposes and that thereafter no building or structure be
permitted thereon which would interfere with such use by the Board
of Water Commissioners; now, therefore,•be it
RESOLVED, That the Council of the City of Saint Paul
hereby grants to the Board of Water Commissioners of said City
the right to install, operate, use, and maintain a principal
feeder water main in the tract or parcel of property belonging
to the City of Saint Paul described as follows:
A strip of land 30 feet wide, the center line
of which is described as follows: Beginning
at a point on the west property line of Sibley
