and s WHEREAS, the Fire Certificate of Occupancy Program uses cross-training and staff deployment methods which 9 ensure properties are inspected not only with reference to the Minnesota State Fire Code, but also relevant portions of �o the State Building, E]ecRical, Plumbing and Mechanical Codes, as weil as the City's Legislative Code; and �i iz WHEREAS, this approach provides for a comprehensive inspection and limits potential disruptions to the life and �s work within Saint Paul's buildings; and ia �s WHEREAS, the City of Saint Paul is interested in creating a system by which well-maintained residential buildings te are inspected on a less frequent basis than those with more code deficiencies; and » is WHEREAS, this system should be objective in its design and application, and transparent to property owners, i9 managers and occupants; and zo z� WHEREAS, a three-tiered approach to scheduling properties for inspection would further decrease potentia] zz disruption of biennial Fire Certificate of Occupancy inspection by allowing residentia] buildings with very few or no zs deficiencies to be inspected on a five-year cycle, those with some deficiencies to be inspected on a three-year cycle, za and those with many deficiencies to be inspected on a one-year cycle; and 25 ze WHEREAS the Department of Fire and Safety Services, Division of Fire Prevention, under the leadership of the Fire n Marshal, devised a system to categorize Certificate of Occupancy properties into three groupings using the attached zs listing of deficiencies and associated point values whereby properties with an average of 4 or fewer points per unit z9 would be C—ategery Class A properties, those properties with an auerage of 5 to 10 deficiency points per unit would be so Eategery Class B properties, and those with an average of 11 or more deficiency points per unit would be Eateger3= si Class C properties; and 32 33 WHEREAS, in 2001 the Division of Fire Prevention conducted a one-month pilot study of all 114 properties renewing sa their certificates of occupancy and found that 37% of the properties were Category A, 26% were Category B, and 37% ss were Category C; and 36 s� WHEREAS, based also on this pilot, the Division of Fire Prevention estimates that implementation of this system ss would result in a minimum 1 I% reduction in inspection volume; and 39 ao WHEREAS, in November 2006, Saint Paul City Council research examined all City (Amanda) records for 3,155 a� residentia] fire certificate of occupancy properties and determined that 1,378 (44%) of the properties were Eateger�y az Class A, 877 (28%) were Eategery Class B, and 900 (29%) were Eateger� Class C; and 43 aa WHEREAS, during these times of fiscal constraint, this increase in efficiency could be applied to the development and as implementation of a periodic and systematic inspection program for one and two-unit rental dwellings in the Ciry; Although there are literally thousands of deficiencies inspectors need to be aware of in the conduct of their work, the Fire Marshal has selected a list which can be considered more hazardous. He has attached a point system to this list, with 10 being the most hazardous, and 1 the least hazardous (of those with points assia ed, many have no points assigned). The original point specifications were loosely modeled a Minneapolis program, and has since undergone some revision. This system was piloted in February of 2001 and has been in the City's Amanda computer system since that time. The overall objective of this proposal is to reduce the number of code violations for rental dwellings in St. Paul, which wili improve the quatity of life for residents who rent these units. While I support this overall objective, f have some major concems with the changes as proposed. My 4irst concern is that the number of points that place properties in Class C is too low. I believe a more appropriate cutoff is 20 points, provided that none of the individual violations are scored 7 points or higher. With the current cutoff of 11, it is far too easy for a few lower-point value violations to add up to 11, which would place the property in Class G. Class C status will stigmatize a property that doesn't have any major safety or health issues by treating it in the same manner as a property that has numerous major problems. Class C status may discourage good tenants from considering a unit that they otherwise would find suitabte for their needs. I agree that the bar for Class A status should be set high, but the Class B bar needs to be lowered. My second concern is the process for conducting the inspections. Most landlords who only manage a couple of units also have full-time jobs. Will inspectors be avaifable during evening or weekend hours so that working people will not have to incur the unreasonable expense of having to miss work, or use precious vacation time to meet this new requirement? If the inspection process becomes too onerous to smali-scale landlords, most of whom live either in St. Paul or nearby communities, many wiil consider selling out because the hassle factor is too high. St. Paul needs to encourage local ownership of rental properties, this wifl discourage it. My third concern is with the price for the inspections. I manage one unit on a break- even basis. I will need to raise the rent in order to cover this new cost, as well as the added costs of going through the very extensive list of requirements and spending a lot of money all at once to fix stuff that doesn't put my tenant in any danger. lf I don't fix everything right now, then I will face expensive annual inspections if my property gets placed in Class C. My tenant is low-income. I don't want to force this person to have to move because my unit is no longer affordable. This brings me to my next point, and that is affordability. This will have an impact on the number of affordable housing units available in St. Paul. Landiords cannot continue to absorb expenses and keep rents affordable. ✓�Q�I��'U There is no mention in the ordinance as to the timetable fqr implementation, or how selections will be made of who gets hit first. Will it be by lottery, or by the number of complaints that have been filed? What about inspections in winter months, when weather-related deficiencies cannot be corrected (such as painting exterior surfaces, roofing, etc.)? Guidelines must be developed that will treat landlords fairiy under these circumstances. I recommend that the inspections for one and two-family dwellings not begin until January 2008. Between now and then, the City needs to publicize the change, put out the requirements list in plain language so any ordinary person can ciearly understand each and every item, and the City needs to provide technical assistance to landlords who request it so they can be sure that their properties wiil pass the inspection. One final note: is there evidence that the overall condition of single-family and duplex rental units is substantially different from the condition of similar owner-occupied properties? If we are going to enforce buiiding codes to such a high level of detail, then we should treat all properties the same, not single out owners of rental properties. Property taxes are already substantially higher for residential rental units than for similar owner-occupied dwelling units. We all know of owner-occupied houses that are in terrible condition.
