Farm Property; nleas, The City has • the office of tr¢ WHEREAS, the Council of the City of Saint Paul fpr uEa2,rer heretofore, by Resolution, Council File No. 192498, directed the proper City officers to proceed with the sale of portions of the so- called Old Workhouse Farm Property; and WHEREAS, the City has heretofore filed in the office., of the Register of Deeds in and for Ramsey County a plat of certain portions of said property under a plat entitled Battle Creek Heights Plat 2, on file and of record in the off ice of the Re §3stbr of Deeds in and for Ramsey County at Page 5 in Book 77 of Town Plats; and WHEREAS, the Council has heretofore, by resolution, Council File No. 202954, authorized and directed the proper .City officers to dispose of Blocks 9, 10, 11, 12, 13, 14 and 16 of said Battle Creek Heights Plat 2; and 'WHEREAS, said blocks were offered for public sale by the City on August 4, 1961 with the exception of Block 9, which-was withdrawn because the Highway Department indicated that it was interested in acquiring a portion of said Block 9; a nd_ WHEREAS, the City.. received no bids--.on-any-of the -af ore --- - said blocks offered at such public sale; and WHEREAS, the City has received an offer from the Battle - Creek Development Co., a Minnesota corporation, indicating a desire by said company to purchase Blocks 9, 10, 11, 12, �' 13, 149,15 and 16, Battle Creek Heights Plat 2," with the exception of portions of Blocks 9 and-15 which the Highway Department - is desirous of acquiring; and WHEREAS', such proposal to purchase by the Battle Creek Development Co. is more fully and completely set forth in the proposed contract for deed which has been marked "Exhibit A ", attached hereto and made a part hereof by reference, to w COUNCILMEN Yeas Nays Dalglish Holland Loss Mortinson Peterson , Rosen Mr. President, Vavoulis 10111 8-82 In Favor Against Adopted by the Council ' 19— t Approved 19— Mayor 3' 21�� Page 2. be hereafter filed in the office of the City Clerk of the City of Saint Paul; and WHEREAS, pursuant to the provisions of Ordinance• of :the City of Saint Paul No. 6576, as amended, the Valuation Engineer of the City of Saint Paul has made an appraisal of the afore- said properties as the same are described in the attached Exhibit A and has determined that the present market value of such properties is in the amount of $200,727.67, which is the proposed purchase price as set forth in the attached Exhibit :4•,Py�f A; and WHEREAS, the said Valuation Engineer of the City of Saint Paul has recommended to the Land Committee of the City, pursuant to the provisions of the aforesaid Ordinance No. 6576, as - amended, that the City accept the offer to purchase as out- lined in the proposed Contract, Exhibit A; and WHEREAS, the Land Committee of the City has recommended to the City Council the sale of the above mentioned tracts or parcels pursuant to the terms, conditions and provisions of said Ordinance No. 6576, as amended, and subject to the terms, provisions and conditions set, forth in the proposed Contract, Exhibit A. Now, Therefore, be it RESOLVED, That the Council of the City of Saint Paul finds that the aforesaid properties as described in the attached Exhibit A are no longer needed by the City and hereby accepts the offer to purchase outlined by the Battle Creek Development Co. in the attached Contract, Exhibit A, and directs the proper City officers to execute, on its behalf, a contract for sale containing terms, pro- visions and conditions as outlined in Exhibit A; be it FURTHER RESOLVED, That the Council hereby directs that the moneys received in connection -with such sale, in accordance with law and in accordance with the provisions of Chapter 353, Laws of Minnesota for 1955, as amended, be assigned and set over to the Detention Commission Receipts Fund 1048, less any expense incurred by the Department of Public Works in preparing--the aforesaid lands for sale, for which expense the Department of Public Works shall be reimbursed from such sale proceeds, and less such amounts as would have been assessed against the aforesaid properties if the same had been properties owned by a private individual for the installation of sewer in Burns Avenue and the grading of Burns Avenue done prior to the passage of this Resolution, such sums being approximately in the amount of $14,716, ORIGINAL TO CITY CLERK 10 8 CITY OF ST. Neyandt, Purchasing Agent Gentlemen: At the - request of your committee the undersigned submits the attached appraisal of Blocks 9 through 16, Battle Creek Heights, with a net area of 41.63 acres, exclusive of streets. The total purchase price, exclusive of unpaid assessments for water mains, and excluding 1.25 acres of land to be taken by the State of Minnesota for highway purposes, but including unpaid assessments for grading and sewer in Burns Avenue, all as set out in the attached appraisal, has been determined to be the sum of $200,727.67, which averages out to $1,970.97 per acre and which compares favorably with other lands sold in the vicinity. It is my opinion that the attached offer made by the Battle Creek.Development Company, which offer was negotiated to the above purchase price, is consistent with current values in the vicinity, and I recommend that the City enter into the attached agreement for the sale of the lands described in the contract for deed under the terms and conditions prescribed therein. jt Very truly yours, � (a Eltor A. Vavoulis Mayor of the City of Saint Paul Court House Saint Paul 2, Minnesota Dear Sir: The undersigned hereby offers to purchase from the City of Saint Paul the following described property, to -wit: Blocks nine (9) , ten (10) , eleven (11) , twelve (12) , thirteen (13) , fourteen (14) , fifteen (15) and six- teen (16) of Battle Creek Heights Plat #2 on file and of record in the office of the Register of Deeds in and for Ramsey County, Minnesota, upon the terms and conditions hereinafter set forth: 1. City of Saint Paul, as vendor, shall enter into a contract for deed with the undersigned, as vendee, for the sale of the above described property to the undersigned by warranty deed upon the prompt and full performance by the undersigned of its part of the agreement under said contract for deed. 2. The agreed purchase price shall be the appraised value of the above described property as reflected in the written. "Notice of Sale of Lands Owned by City of Saint Paul ", dated July 10, 1961, issued by the Council of the City of Saint Paul in connection with the City's proposed public auction of the above and other property scheduled on August 4, 1961: 3. The purchase price above provided shall be paid in the following manner, to -wit: the sum equivalent to 4% thereof on the date of the execution of said contract for deed; the sum equivalent to 3% thereof on or before ninety days from said date; the sum equivalent to 3% thereof on or before six months from said date; and thereafter the sum equivalent to 10% thereof on or before each of the nine consecutive annual anniversary dates of said contract for deed. 4. Interest at the rate of 6% per annum on the unpaid principal balance shall be paid at the time of the pay- ment of the principal installments. 5. 'The City of Saint Paul shall release and deliver unto the undersigned good marketable title by warranty deed to any part or portion of 5 acres or more of the above described land requested in writing by the undersigned, from time to time, upon the payment concurrently made to the City of a sum equal to one and one -half times the said appraised ##2 value per acre, or portion thereof, requested for such release- of land from time to time shall constitute a payment on account of and a credit on the next annual principal and interest instalment or instalments due or to become due under said contract for deed. 6. Undersigned shall pay all taxes due and payable in the year 1964, but shall not be required to pay special assessments heretofore or hereafter levied for any improvements existing as of the date of said contract for deed. 7. The contract for deed form to be executed shall be form ##5611,of the Uniform Conveyancing Blanks set forth in Volume 29, Minnesota Statutes Annotated, at pp. 374 -376, but the terms, conditions and provisions thereof in conflict with or repugnant to any of the terms, conditions and pro- visions hereinabove set forth shall be eliminated and said form of contract for deed made to conform with this proposal.
