Section.l. That the Zoning Code, Chapters 60 to

Dear Madam:
This is in the matter of the petition of the Schneider Company to
rezone from an "A" residence district to a "C" residence district
five (5) platted lots situated on the west side of unimproved
McAfee Street, approximately 175 ft. north of the north line on
Maryland Avenue. The subject property is described as Lots 1 through
5 inclusive, Block 3, Brenner's Add. No. 2.
On November 15, 1962 the Commissioner of Finance reported the petition
sufficient in that 13 of the 16 property owners (91.5 %) within the
prescribed 100 ft, radius had signed the petition.
The subject property has a frontage of 323.44 ft. and extends to
an average depth of 217 ft., resulting in an area of approximately
70,186 sq. ft. This property consists of a swamp and peat bog and
at one time was a part of the overflow area of Lake Phalen.
Field investigation discloses that it is very doubtful that this pro-
perty could be developed for single- or two - family use because of
its physical characteristics. It is the petitioner's intent to de-
velop the site with one 23- unit -one- bedroom apartment building and
two 11 -unit two - bedroom apartment buildings, as indicated on his
attached plan.
The properties to the north are presently vacant and the properties
to the east across unimproved McAfee Street were recently classified
to "C" residence for anticipated apartment development. Directly south
and adjoining is al,new single - family residence and church which front
on Maryland Avenue; west and adjoining is the Northern Pacific rail-
road tracks (Duluth line).

In consideration of the above factors, the Board of Zoning recommends
that the subject property be rezoned from "A" to "C" residence.
