BE IT RESOLVED, that, upon the petition of the Saint Paul Port Authority, as documented in
Public Works Technical Services, Vacation File Number 16-2006, the public property hereinafter
described, as follows and on attac6ed map Exhibit A, is hereby vacated of its interest as street
right-of-way:
That part of Frank Street as dedicated in the plat of Terry's Addition to the
City of Saint Paul, Ramsey County, Minnesota lying between Block 5 and
Block 6 of Terry's Addition and lying between Easterly extensions of the
Northerly and Southerly lines of said Block 6;

RESOLVED, that, subject to the herein stated exceptions and with the accompanying Utility
Easement Certificates of Intended Non-Use, filed voluntarily on behalf o£ District
Energy/District Cooling St. Paul, a private, non-profit Minnesota corporation; Qwest, a
Colorado corporation; Comcast, a Pennsylvania Corporation; The City of Saint Paul Public
Works for the City of Saint Paul, a municipality; made a part hereof by this reference and
filed in the office of the City Clerk of Saint Paul, the City, for itself and on behalf of these
corporations and departments, waives the right to the street right-of-way and utility easements in
the area to be vacated, described above and subject to the following, including:
This vacation shall be subject to the terms and condition of Chapter 130, codified March 1, 1981,
of the Saint Paul Legislative Code as amended, and to the following conditions:
l. That the petitioners, their successars and assigns sha11 pay $600.00 as an administrative
fee for this vacation which is due and payable within 60 days of the effective date of this
resolution.
2. That the petitioner, their successors and assigns agree to indemnify, defend and save
harmless the City of Saint Paul, its officers and employees from a11 suits, actions or claims
of any chazacter brought as a result of injuries or damages received or sustained by any
person, persons or property on account of this vacation, or the petitioners' use of this
property, including but not limited to, a claim brought because of any act of omission,
neglect, or misconduct of said petitioners or because of any claims or liability arising from
any violation of any law or regulation made in accordance with the law, whether by the
petitioners or any of their agents or employees.

I recommend a public hearmg before the City Council be held on October 18, 2006
to consider the petition of the Saint Pau1 Port Authority.
This petition is to vacate street right of way in a small portion o£Frank Street.
The purpose of this vacation is to make title work as clean as possible for possible
future development. There will be no building within the vacated azea.

Addition and lying beriveen the Easterly extensions of the Northerly and Southerly
lines of said Block 6.

This portion of Frank St. was dedicated in the 1875 Ylat of Terry's Addn. to the City of St. Paul, and may have been
intended as a future northerly extension of Frank St. According to City records, there has never been a northerly
extension of Frank St. at this location, and the parcel we seek to vacate has been included as a part of Tax Parcel
28,29.22.42.0004 for many years. Applicant does not intend to cons[ruct buildings within the vacated Frank St. area.

The City Cierk has refeaed to this office for recommendafion the petition of The Saint Paul Port
Authority for that 10' X 60' portion of Frank Street as platted in Terry's Addi6on of Saint Paul.
As indicated, this inquuy pertains to the vacation of City right-of-way only; utility easements
may remain in place even if street usage is removed.
The putpose of this vacation is to allow for the Globe property to be sold with as few tifle
encumbrances as possible. No construction is planned within the azea to be vacated.
Will you please advise me of any concems you may have regarding this proposed vacation as
soon as aossibie. I would like to receive your comments before September 8, 2006 so I can
prepare a report to the City Council on this matter. If you would rather respond on your
letterhead, please refer to the above listed file number when replying. For your convenience, you

RE: Public Works Vacation File No.16-2006 (Vacate Street Right of Way)
I recommend a public heazing before the City Council be held on October 18, 2006
to consider the petifion of the Saint Paul Port Authority.
This petition is to vacate street right of way in a small portion of Frank Street.
The purpose of this vacation is to make title work as clean as possible for possible
future development. There will be no building within the vacated area.
This property is located in City Council Ward 7, Planning District 4.
