That Ordinance No. 123 -87, approved January 1963, is hereby amended by adding to Section 1 an additional area known as the Village of Birchwood to be included in the sanitary sewer service area, said area described as follows: "Except for a body of water known as White Bear Lake, the SW-j of Section 19, Range 215 Township 30; and the NW-k of Section 30, Range 21, Township 30; and the Wj- of the NEJ of Section 30, Range 21, Township 30; and, the NR-j of the SE -J, ,Section 30, Range 21', Township 30." ;Section 2'. This ordinance is hereby declared to be an emergency ordinance rendered necessary for the preservation of the public peace, health and safety. Section 3. That the_tiVillage of Birchwood is hereby authorized to connect the Birchwood sewer system to the White Bear Lake sewer system for sanitary ' sewage disposal. i 2. The City Council of the City of White Bear Lake hereby requests that the City Council of the City of Saint Paul amend Ordinance No. 12387, Section I to include the area that will be served through White Bear Lake's sewer connection with the City of Saint Paul sewer system the following described area in addition to that area presently being served: SW 1/4 Sec 19, R 21, T 30 &'the NW 1/4 Sec 30 , R_21, T 30 & the W 1/2 of NE 1/4 Sec 30, R 21 T :30, & the NW 1/4 of SE 1/4, Sec 30, R 21, T 30, except that part being_White Bear Lake. 3. The Board, however, desires to make it clear that they do not feel they are authorized to pass upon contract provisions re- lating to the costs, charges, and apportionments thereof- - this matter remains one of direct negotiation between the communities involved. The provision in the law (Chapter 95 of Minnesota Extra Session Laws of 1961) requiring contracts between the cities of the first class and adjoining communi- ties be made subject to approval of the Board of Trustees is for the purpose only of keeping the Board informed of increased loads which the District would have to treat by virtue of these additional contracts, which prior to the amendment in Chapter 95, were not made known to them.
