OTHERWISE REQUESTED
It is a pleasure to advise you that the Board of Trustees,
at its June 8'`, 1964 meeting, adopted Resolution.No. 1044,
certified copy of which is attached, unanimously approving
the City of White Bear Lake to connect its sewer system to
the Village of Birchwood.
The Board, however, desires to make it clear that they do not
feel they are authorized to pass upon contract provisions re-
lating to the costs, charges, and apportionments thereof- -
this matter remains one of direct negotiation between the
communities involved. The provision in the law (Chapter 95
of Minnesota Extra Session Laws of 1961) requiring contracts
between the cities of the first class and adjoining communi-
ties be made subject to approval of the Board of Trustees is
for the purpose only of keeping the Board informed of increased
loads which the District would have to treat by virtue of these
additional contracts, which prior to the amendment in Chapter
95, were not made known to them.
Yours very truly,
For the Board of Trustees
