The hearing before the �City Council on the advisability of proceeding _
with the subject improvement was held on March 31, 1964, and on that
date was postponed until April 21, 1964. A number of abutting property
owners spoke in opposition to the improvement at the hearing of
March 31st and the matt�er was referred to the Finance Department for
further study and repor;t.
Apparently, the main re�ason for objections against the construction
of this sewer is the co�st thereof and the resulting assessments. The
assessment rate has been estimated at $10.65 per assessable foot and
would result in rather high assessments agai.nst a number of the abut-
ting properties, the tw"o highest being estimated at $1,330 and $800.
�
One of the objectors, a�;Mr. Myron Roth, Jr. , questioned whether he �
would be allowed credit± because of costs incurred by him in construc- G
ting a private sewer connection late last year. Mr. Roth is the appar- �
ent owner of the southe"rlymost 125 feet of property abutting the sewer 1
on the east side of Pro'sperity Avenue. The sewer thus constructed by +
Mr. Roth is a private s;ix-inch connection which means he could only 4
receive credit in the ari�ount of $636.20, said sum being the amount paid �
by Mr. Roth as an advance payment in connection with the issuance of �
his sewer connection permit. The other properties in this block cannot �
connect their sanitary house drains into this private connection as it �
would violate all existing codes and statutes. �

Insofar as the lack of sewer in this street does not create a health 4
hazard; and, whereas a petition requesting the construction of the 1
sewer was signed by only one of the five affected property owners, I
would recommend that this improvement be discontinued until such ti.me
as a more complete petition, signed by a minimum of three owners of
abutting property, has� been received by the City.
