RESOLVED, upon the pertinent appeal, under the Zoning
Code, by Highview Nursing Home, Inc. as the owner of the subject
real estate situate in the City of Saint Paul, zoned in IIC"
Residence District, under said Zoning Code, and described as
follows:
Lots 23, 24, 25, 267 29, 30, and the north
one -half of vacated alley adjacent to Lots
25 and 26, and all of the vacated alley between
Lots 23, 24, and 29 and 30, Block 86, Dayton &
Irvinets Addition, according to the plat thereof
on file and of record in the office of the Register
of Deeds in and for Ramsey County, Minnesota;
and located'on the south side of Irvine Avenue, east of Western
Avenue, and'the north side of Pleasant Avenue, east of Ramsey
Street, that the provisions of said Zoning Code hereby are
determined and varied as and to the extent necessary therefor,
and the building setback line for said real estate, in respect
of the line of Irvine Avenue, upon which the same abuts, hereby
is established as a line drawn across said real estate parallel
thereto and consistently 14 feet distant from said line of said
Irvine Avenue, and that a special permit hereby is granted
unto said Appellant and its successors in interest f "or the
enlargement'and extension of the existing Nursing Home, on
said real estate, so that the existing bed capacity of the
same shall be increased from 52 beds to 70 beds, and for the
maintenance and operation of the same as so enlarged and
extended; provided that said Appellant and its successors in
interest, otherwise, shall make due compliance with all
ordinances, statutes and rules and regulations of public
authorities applicable in the premises.

Dear Sir:
This is in reply to!tbe referral'of the appeal of the Higbview
Nursing Home Inc. to 1) increase the capacity of the nursing
bome from 52 to 70 beds, and.2) relax the required 16 foot
setback from Irvine Street to 14 feet on property located on
the soutb side of Irvine Avenue, east of Western Avenue, and the
nortb side of Pleasant Avenue east of Ramsey- Street. The property
is described as Lots 23, 24, 25,'26,-29, 30, and the -north A of
vacated alley adjoining Lots 25 and 26, and all of vacated alley
between Lots 23,24 and 29 and 30, Elock 86, Dayton & Irvine's Addition.
The property is zoned "C" residence.
The Board of Zoning•considered this matter at its regular meeting '
on July 1, 1964. The staff reported that the relaxation of the
setback as required would not -have a detrimental effect on any of
the adjoining properties and that there is no objection to the addi-
-tion to increase the bed capacity of the existing nursing home. In
consideration of these factors, tbe`-Board of Zoning recommends the
granting of the appeals as outlined above.

consider the matter of the application of Highview Nursing Home Inc.
for the following:
1) for appeal to construct an addition to existing nursing
home so as to increase the bed capacity from 52 beds to
70 beds
2) for appeal to relax required 16 foot building line setback
from Irvine Street to 14 feet
The property involved is described as: Lots 23, 24, 25, 26, 29, 30
and the north 1/2 of vacated alley adjoining Lots 25, and 26, and all
of the vacated alley between Lots 23, 24 and 29 and 30, Block 86,
Dayton and Irvine's Addition, and is located on the south side of
Irvine east of Western Avenue and the north side of Pleasant east of
Ramsey Street.
A public hearing i -rill be held in the Council Chambers of the Court
House and City Hall in the Cit -r of St. Paul, at 10:00 a.m. on
August 13, 1964.
