PAUL COUNCIL NO OFFICE OF THE CITY CLERK FILE COUNPIL RES LUTION— GENERAL FORM PRESENTED BY COMMISSIONE DATE RESOLVED, upon the pertinent appeal, under the Zoning Code, by St. Mary's Association as the owner of the subject real estate situate in the City of Saint Paul, zoned in IICII Residence District, under said Zoning Code, and described as follows: Lots 13 and 14, Block 7, Davern=s Burren Addition to St. Paul, Minn., according to the plat thereof on file and of record in the office of the Register of Deeds in and for Ramsey County, Minnesota; and located on the east side of Prior Avenue between Norfolk and Graham, that the provisions of said Zoning Code hereby are determined and varied as and to the extent necessary therefor, and the building setback line for said real estate, in respect of the east line of Prior Avenue, upon which the same abuts, hereby is established as a line drawn across said real estate parallel thereto and six (6) feet distant from said east line of said Prior Avenue, and that a special permit hereby is granted unto said Appellant and its successors in interest for the enlargement and extension of the existing home for the aged on said real estate, so that the existing bed capacity of the same shall be increased from 74 to 92 beds, and for the maintenance and operation of the same as so enlarged and extended; provided that said Appellant and its successors in interest, otherwise, shall make due compliance with all ordinances, statutes and rules and regulations of public authorities applicable in the premises. The property is zoned C " Residence'' ' The Board of Zoning'',considered this matter at its regular meeting on July 1, 1964. The staff reported_that a field investigation discloses that the requested six -foot building line from the east side of Prior Avenue would not have a detrimental effect on any of the adjoining properties in the block. A letter of acquiescence to the proposed six - foot building line has been received_,from the property owner adjoining to the north. Therefore, the Board of Zoning recommends the granting of the appeal to enlarge the existing facility to a total bed capacity of 92 beds, and the appeal to establish a;six -foot building line setback from the east side of Prior Avenue for the -above described property.
