A public hearing having been had upon the taking and condemnation of the lands or easements
therein, for the above improvement, 'and the award of damages, therefor, and also upon the assessment
of benefits therefor, and the Council having duly considered the same, now therefore be it
Resolved, That the taking and condemnation of the lands described in the annexed assessment roll,
identified by the signature of the Commissioner of Finance, and made a part hereof, and the awards of
damages to the owners of such lands for said taking and condemnation as set forth in said assessment
roll, be and the same is hereby in all respects ratified and confirmed.
Resolved further, that the said assessment of benefits, be and the same is hereby in all respects
ratified, and the same is hereby ordered to be submitted to the District Court for confirmation.

In re: The assessment of benefits in connection with
the grading of Sixth Street from Hazelwood Ave. to
Birmingham St., and Barclay Street from Sixth Street
to Margaret Street.
The matter before the Council this morning is the ratification of the
award of damages in connection with the grading of the streets referred
to above. On July 14, 1964, the City Council passed a final order,
identified as C.F. 219172. The assessment as proposed at the time of
the passage of the subject final order was $14.95 per assessable foot
for the property on the south side of Sixth Street which is the new
Harding High School site, and $12.95 per assessable foot for the pri-
vately owned property on the north side of Sixth Street.
The Council instructed the Finance Department and the Department of
Public Works to consult with the officials of the Department of
Education for the purpose of determining whether the Department of
Education would be willing to pay a larger share of the costs.
Prior to our meeting with the Department of Education, we re- analyzed
the benefits that would accrue to the Harding High School site because
of some of the incidental work that would be performed in connection
with the grading of Sixth Street. Our analysis disclosed that an
additional amount of $1,870 could be applied against the Harding High
School site as additional benefits. The assignment of this $1,870
against the Harding High School site would result in an estimated rate
of $10.80 per assessable foot for the north side of Sixth Street. The
Department of Education recognizes that this is not a normal situation
and in light of this would reluctantly acquiesce to this proposal.
We recommend that this report be accepted by the Council and the
Finance Department will proceed on the premise that the estimated
assessment rate for the north side of Sixth Street will be $10.80
per assessable foot.
Please be advised that this is an exceptional case and that the policy
of treating school property the same as residential property for other
projects of this nature should be continued.

propriated for the above improvement and the amounts of the awards of damages therefor to the own-
ers thereof, and the persons to whom such awards are payable; that he has also fixed and determined
the amount of benefits to property, from the making of said improvement, not exceeding the cost
thereof, and that attached is an assessment roll entitled as above and identified with the signature of
the undersigned, containing the undersigned's finding on said matters.
