Minn. Proj. No. 1 094- 3 (89) 242 T Transmitted herewith are four copies of a proposed agreement between this Department and the City of St. Paul relative to the oversize construction of the Trunk Highway No. 94 storm sewer from the inplace Phalen Creek sewer at Commercial Street to Pl•Ira Street, which have been executed by the City. This agree- ment covers Stage I of the oversize construction as requested by the City from Cypress Street to the Phalen Creek outlet to serve an inadequately sewared'area of the City. Also, transmitted herewith are four copies of a revised page 5 of the agreement. The revision consists of the addition of a new Article, Article VI.,-- which provides that "The City shall, in consideration of payment by the State of part of the'` cost of constructing the sorm sewer -system con- _ templated herein and upon the State's completion of the remaining portion of the mainline storm sewer and the.connec- tions to the City's storm sewer system in the vicinity of Cypress Street, assume the maintenance of said storm sezrer system - without cost or expense to the State." If this revision meets with your approval, please submit it to the necessary City officials for approval and insert it inplace of the present page 5 in all foie: copies of the agreement.
