interest as street right-of-way:
That portion of Dodd Road right-of-way upon which the property at 677
Dodd Road encroaches. The property is described as the South 13 feet of the
East 85 feet of Lot 1, Block 133, West St. Paul, egcept that part taken for
South Wabash Street and the Esst SS feet of the North half of Lot 2, Block
133, West St. Paul, except that part taken for South Wabasha Street.
The encroaching area, to be vacated, is legally described on attached Exhibit
A(page 2 of 2); and be it further
RESOLVED, that, subject to the herein stated exceptions and with the accompanying Utility
Easement Certificates of Intended Non-Use, filed voluntarily an behalf of: District
Energy/District Cooling St. Paul, a private, non-profit Miunesota corporation; Qwest, a
Colorado corporation; made a part hereof by this reference and filed in the office of the City
Clerk of Saint Paul, the City, for itself and on behalf of these corporations and departments,
waives the right to the street right-of-way and ufility easements in the area to be vacated,
described above and subject to the following, including:
This vacation sha11 be subject to the terms and condition of Chapter 130, codified March 1, 1981,
of the Saint Paul Legislative Code as amended, and to the following conditions:
1. That the petitioners, their successors and assigns shall pay $300.00 as an admiuistrative
fee for this vacation which is due and payable within 60 days of the effective date of this
resolution.
2. That Northern States Power Company d/b/a Xcel Energy (Gas & Electric), a Minnesota
Corporation, shall retain an easement within the vacated azea for itself, its successors and
assigns, for the purpose of maintaining, repairing and replacing existing natural gas and
electric lines for so long as Xcel maintains such natural gas and electric lines in the
vacated area. Except for existing, no buildings, shuctures, trees or any temporary
structures, material storage, fixture or any other objects which may prohibit normal access
to natural gas facilities for maintenance purposes will be permitted with the easement
area.

That this vacation shall be for the life of the existing iznprovements withiu the
encroachment (ail of which are hereinafter referred to as the "Improvements") andlor the
repair or reconshuction of the foregoing Improvements. At such time as the
Improvements no longer encroach upon the vacated property, the vacated properry shall
revert back to the City as public right-of-way.
4. That the petitioner, their successors and assigns agree to indemnify, defend and save
hannless the City of Saint Paul, its officers and employees from all suits, actions or claims
o£ any chazacter brought as a result of injuries or damages received or sustained by any
person, persons or property on account of this vacation, or the petitioners' use of this
properiy, including but not limited to, a claim brought because of any act of omission,
neglect, or misconduct of said petitioners or because of any claims or liability arising from
any violation of any law or regulation made in accordance with the law, whether by the
petitioners or any of their agents or employees.
5. That the petitioners, their successors and assigns sha11, within b0 days of the effective date
of this resolution, file with Public Works, City Rea1 Estate, an acceptance in writing of the
conditions of this zesolution and shall, within the period specified in the terms and
conditions of this resolution, comply in all respects with these terms and conditions.

I recommend a public hearing before the City Council be held on October 4, 2006
to consider the petition of Thomas and Yvonne Everling.
Ttris petition is to vacate street right of way in part of Dodd Road to mclude the azea
upon which the c�srent residence encroaches.
The purpose of this vacation is to facilitate re-sale of the property by amending the
title work to include vacat'nng the encroachmg azea. The e�usting building will
remain; no additional building will be allowed, and at such time as building no
longer remains, the right of way azea will revert to the City of Saint PauL
This property is located in City Council Wazd 2, Planning District 3.

The City Clerk has referred to this office for recommendation the petition of Yvonne & Thomas
Everling for the vacation that part of Dodd Road right of way as their building currently occupies.
As indicated, this inquiry pertains to the vacation of City right-of-way only; utility easements
may remain in place even if street usage is removed.
The purpose of this vacation is to a11ow for the property at 677 Dodd Road to be sold with as few
title encumbrances as possible. Please note: any vacation resolution pertaining to this property
will contain reversionary language; i.e. if the structure is removed or destroyed, no rebuilding
will be allowed in the right of way, and the right of way reverts to the City.
Will you please advise me of any concems you may have regarding this proposed vacation as
soon as uossible. I would like to receive your comments before September 1, 2006 so I can
prepare a report to the City Council on this matter. If you would rather respond on your

RE: Public Works Vacation File No.14-2006 (Vacate Street Right of Way)
I recommend a public hearing before the City Council be held on October 4, 2006
to consider the petition of Thomas and Yvonne Everling.
This petition is to vacate street right of way in part of Dodd Road to include the azea
upon which the current residence encroaches.
The purpose of this vacation is to facilitate re-sale of the property by amending the
title work to include vacating the encroaching area. The existing building will
remain; no additional building will be allowed, and at such time as building no
longer remains, the right of way area will revert to the City of Saint Paul.
This property is located in City Council Ward 2, Planning District 3.
