1 WFIEREAS, The Cily Council of the City of Saint Paul, pursuant to Chapter 62 of the Adininistrative Code
2 and following the public hearing held on November 2, 2005, did adopt a Resolution establishing the level of
3 Right-of-Way Maintenance Service to be performed in the City of Saint Paul, and the estimated amount of
4 service charges to be levied against benefitted properties, the work to be performed in 2006, and the charges
5 to be collected with the regulaz taxes in 2007; and

7 WHEREAS, The Department of Pubiic Works has performed the approved rig�it-of-way maintenance work
$ and submitted its report together with the total cost of right-of-way maintenance in the amount of

WHEREAS, The City Council deternuned that the City shall pay the sum of $8,436,417 of the right-of-way
maintenance costs by using Municipal State Aid ($1,768,139), Trunk Highway Aid ($302,265), County Aid
($333,466), Miscellaneous Receipts ($1,086,000), Use of Fund Balance ($4,946,547); and the remaining
amount of $1 �,016,878 shall be assessed against benefitted properties, and further resolved that a Public
Hearing was held in the City Council chambers on October 4, 2006, for the purpose of adopting the service
charges against all benefitted properties; and
WHEREAS, The Council of the City of Saint Paul did hold a Public Hearing on October 4, 2006, for this
purpose, and, hauing heard all interested parties, does hereby adopt the following service charges in
accordance with Chapter 14 of the City Charter and said Chapter 62 of the Administrative Code, now,

FINALLY RESOLVED, That the City Clerk is hereby directed to transmit a certified copy of this
Resolution to the Ramsey County Auditor so that the service charges levied herein shall be extended on the
property tax lists of the County and collected in 2007 along with current taxes, and said service charges to
be payable in a single installment.

SCOPE OF WORK IJNDER 2006 RIGHT OF WAY MAINTENANCE ASSESSMENT
Norice is hereby given that a Public Hearing will be held on the 4 day of October 2006 at 530 pm
in the Saint Paul City Council Chambers, City Hall and Court House, Saint Paul, Minnesota. The
purpose of the Public Hearing is to consider the level of Right of Way maintenance performed in the
City of Saint Paul in 2006 and to ratify the cost of such service to be chazged against benefitted
properties in accordance with Chapter 62 of the Administrauve Code.
The particular service has been performed and the esrimated costs as proposed by the Department of
Public Works aze as follows:
CLASS I-A - DOWNTOWN STREETS
Descriprion:
Class I-A service has been performed on all downtown streets (face of curb to face of curb) within
the following boundaries: Kellogg Boulevard on the south and west, Eleventh Street on the north,
and Broadway on the east (except streets listed in Class I-B, Downtown Streets (Brick)).
2006 Level of Services:
The downtown streets have been swept three times per week and flushed five rimes per week. All
rourine maintenance, including patching and repairing of street surfaces, tree trimming, and snow
plowing has been performed on an as-needed basis.
Assessment:
All Class I-A service will be assessed at a rate of $10.30 per assessable foot.
CLASS I-B - DOWNTOWN STREETS BRICKI
Descn_ption:
Class I-B service has been performed on all downtown brick streets (face of cwb to face of cwb):
St. Peter St., from Kellogg Blvd to Sixth St.; Wabasha, from Kellogg Blvd to Sixth St.; Fourth St.,
&om St. Peter to Wabasha; Fifth St., from St. Peter to Wabasha; Sixth, from St. Peter to Wabasha;
Market St., Kellogg Blvd to Fourth St.; Mazket St., Fifth St. to Sixth St.; Washington St., Kellogg to
Fourth St.; Fourth St., St. Peter St. to Washington St.; Fifth St., Mazket to St. Peter St.; Sixth St.,
Market to St. Peter St.; Kellogg Blvd., north side; Wabasha St, just west of Minnesota (Wild) Club
and adjacent to Xcel Arena; and Kellogg $lvd., south side: Seventh St to the RiverCentre Parking
Ramp.
2006 Level of Services:
The downtown streets listed above have been swept three times per week and flushed five times per
week. All rourine maintenance, including patching and repairing of the brick street surfaces, tree
trimming, and snow plowing has been performed on an as-needed basis.
Assessment:
All Class I-B service will be assessed at a rate of $12.27 per assessable foot.

CLASS II- OUTLYING COMMERCIAL AND ARTERIAL STREETS
Descriprion:
Class II service has been performed on all outlying commercial and arterial streets in the City.
These aze the maj or arteries in the City and have both heavy volumes of vehiculaz and pedeshian
traffic and, in most cases, have business or commercial properties fronting on them. Typical
examples would be as follows: University Avenue, Snelling Avenue, West Seventh Street, East
Seventh Street, Rice Street, Payne Avenue, Arcade Street, Summit Avenue, Grand Avenue, and
others. All of these Class II sireets aze accurately defined on a map available for viewing in the
Department of Public Works, 900 City Hall Annex.
2006 Level of Service:
The Class II streets have been swept or cleaned approximately 13 times per season. All routine
maintenance, including patching and repairing of street surfaces, sidewalk maintenance, right-of-
way tree maintenance and trimxning, and snow plowing has been done on an as-needed basis.
Assessment:
Under Class II service there aze two assessment rates, one commercial and one residential. The
commercial properry rate is $5_59 per assessable foot and the residential property rate is $2.29 per
assessable foot.
CLASS III - ALL RESIDENTIAL STREETS
Descrivtion:
Class IiI service has been performed on all residenrial streets including oiled streets, paved streets
and intermediate type streets.
2006 Level of Service:
Residential streets, including oiled, paved and intermediate streets, have received a thorough
cleaning in the spring which included sweeping and flushing. Patching, repair work, sidewalk
maintenance, right-of-way tree maintenance and trimming, and snow plowing has been done on an
as-needed basis. To further improve service and efficiency, a new chip sealing policy became
effective in 2000: All residential streets (oiled and paved) will be chip sealed on an 8 year
cycle. One-eighth of these residential streets (a total of 64 mffes) will be chip sealed each year.
In the fall leaves will be picked up from these streets.
Assessment:
Under Class III service there aze two assessment rates. The commercial property rate is $4_20 per
assessable foot and the residential property rate is $2_17 per assessable foot.

CLA5S IV - ALL OILED AND PAVED ALLEYS
Descriotion:
Class IV service has been performed on all oiled, paved and intermediate type alleys within the City.
2006 Level of Service:
All oiled, paved and intermediate alleys haue been swept during the season. All routine
maintenance, including patching and repair of the alley surface, has been performed on an as-needed
basis. To further improve service and efficiency, a new chip sealing policy became effective in
2000: All alleys (oiled and paved) will be chip sealed on an 8 year cycle. One-eigLth of the
total number of alleys (appro�mately 254 alleys) will be chip sealed each year.
Assessment:
Under Class IV service, there are two assessment rates. The commercial property rate is $0_77 per
assessable foot and the residential property rate is $9_49 per assessable foot.
CLASS V - UNIMPROVED STREETS
Descrintion:
Service has been performed on all unimproved streets. By unimproved, we mean those streets that
have not been developed for one reason or another. They are platted City rights-of-way; however,
the abutting residents have never petitioned for their improvement nor have there been any
assessments levied. Because they aze CiTy rights-of-way, the City has the responsibility to perform
minimal repairs and maintenance work on them to reduce any hazazds or potential hazazds.
2006 Level of Services:
The maintenance and repair of these streets has consisted of patching, minor blading, placing of
crushed rock and other stabilized material, right-of-way tree maintenance and trimming, and snow
plowing in order to make them passable and reduce hazards.
Assessment:
The assessment rate on unimproved streets is $2_21 per assessable foot for commercial
property and $1_24 per assessable foot for residenrial property.

CLASS VI - UNIMPROVED ALLEYS
Descriprion:
Service was performed on unimproved alleys. By unimproved we mean those
alleys that have not been developed for one reason or another. They aze platted City

Comments:
1800's alley; dead-end alley, never any maintenance completed on it, until they call. As
much as she's paying for this assessment Public Works could have black topped it and
been done with it.
The neighbor lady cannot even get into her back yard because the atley has sunk so
badly.
The alley should have been blacktopped years ago.
