WHEREAS, on February 1, 2006, the City Council of the City of Saint Paul adopted
Council File #06-118, said Resolution being the Ratification of Assessments for the
Removal of Diseased Elm Trees From Private Property in 2004 (File No. OSO1T,
Assessment No. 9041), and
WHEREAS, the property at Cumberland Street, being described as:
VAC ALLEY ADJ & N 1/2 OF LOT 28 & ALL OF LOT 29 BLK 8,
EDWIN M. WARE'S CUMBERLAND ADDITION PLAT 1
with the property identification number of 24-29-23-21-0261 was assessed an amount of
$2,251.95 for the removal of a diseased elm tree, and
WHEREAS, at the request of the property owner, the Forestry Unit of Parks and Recreation
for the City of St. Paul investigated the removal of elm tree and determined the above
property, with the identification number of 24-29-23-21-0261, was mistakenly assessed
since the tree was in the public right of way,
THEREFORE BE IT RESOLVED, that the amount of the assessment plus interest for the
property with the identification number of 24-29-23-21-0261 be deleted, and

BE IT FURTHER RESOLVED, that the reduction of $2,251.95 be funded by the Right-of
Way Maintenance Fund.

connection with the making of the above improvement, viz:

Said Valuation and Assessment Engineer further reports that he has assessed

upon each and every lot, part or parcel of land deemed benefitted by the said
improvement; and in the case of each lot, part or parcel of land in accordance
with the benefits conferred thereon; that the said assessment has been completed,
and that hereto attached, identified by the signature of the said Valuation and
Assessment Engineer, and made a part hereof, is the said assessment as completed
by him, and which is herewith submitted to the Council for such action thereon as
may be considered proper.

A public hearing having been had upon the assessment for the above
improvement, and said assessment haviing been further considered by the Council,
and having been considered finally satisfactoiy, therefore, be it
RESOLVED, That the said assessment be and the same is hereby in a11
respects ratified.
RESOLVED FURTHER, That the said assessment be and it is hereby determined
to be payable in One equal installments. Except file's J0504C, JOSOSC to be
payable in Ten equal installments and file OSO1T to be payable in Twentv equal
installments.
