par value amount of $2,500,000, authorized by
Chapter -341, Minnesota Session Laws for 1933,
as amended; Chapter 445, Minnesota Statutes
Annotated, as amended, for the purpose of the
procurement of funds in said amount for applica-
tion in partial payment of the duly apportioned
obligation of said City of Saint Paul for the
payment of the cost of that portion of the
expansion of the sewage system and treatment
plant of Minneapolis -Saint Paul Sanitary Dis-
trict proposed to be constructed i n the year
1965,,and to constitute part of the expansion
thereof proposed to be constructed in its
entirety during the years 1963, 1964 and 1965,
such sewage system and treatment plant having
been and to continue to be established and main-
tained for the collection, treatment and disposal
of sewage and waste materials, used by said
City of Saint Paul jointly with tIB City of
Minneapolis, and comprising and to continue to
comprise a part of the complete plan of sewage
and waste material collection, treatment and
disposal system of said Minneapolis -Saint Paul
Sanitary District, as authorized by said Chapter
341, Minnesota Session Laws 1933 as amended
(Chapter 445 Minnesota Statutes annotated, as
amended). This is an emergency ordinance
rendered necessary for the preservatlDn of the
public peach., health and safety.
WHEREAS, under and by authority of Chapter 341,
Minnesota Session Laws for 1933, Minneapolis -Saint Paul Sanitary .
District was established and thereafter the Board cf Trustees of
said Sanitary District prior to the construction or opertion
of the Sewage Disposal System of said Sanitary'District, under
and-by authority of said Act, did adopt the Comprehensive Plan
and Program of Procedure and Work, of said Sanitary District,
for the collection, treatment and disposal of sewage and waste
materials of said Sanitary District, and thereunder and in accordance
therewith, as modified prior to April 9, 1962, among other things,
said Sanitary District did construct and has since maintained and
operated the Sewage System and Treatment Plant for said purposes;
and
WHEREAS,

Statutes Annotated, as amended, by its Resolution No. 956, a
copy whereof is herewith filed and incorporated herein by
reference, provided therefor and effected the modification of
said Comprehensive Plan and Program of Procedure and Work, of
-said Sanitary District, designated "Project I -10 ", as adopted
November 13, 1933, and as then amended, so that thereby pro-
vision has been made for the expansion of said Sewage System
and Treatment Plant, of said Sanitary District, during the years
1963, 1964 and 1965, at an estimated and probable cost of
$21,710,000.00, such expansion to involve capital additions to
said Sewage System and Treatment Plant which shall provide addi-
tional capacity of said Treatment'Plant and increased facilities
therein for secondary treatment of sewage and waste materials
by the high -rate activated sludge process, among other things,
all as more particularly appears from said Comprehensive Plan and
Program of Procedure and Work as modified by said Resolution
No. 956; and said Board of Trustees of said Sanitary District,
in accordance with said Resolution No. 956, having further pro-
vided for the construction of an uncompleted part of the afore-
said subject expansion of said Sewage System and Treatment Plant,
in the year 1965, at an estimated and probable cost of $9,085,964.00,
and therefor having further adopted its "Capital Additions" item
of the 1965 Budget of said Sanitary District in thesame amount
and thereby and therein apportioned the said "Capital Additions"
item, $9,0851964.001 for payment as follows: $3 957,846..00 for
payment by said City of Saint Paul and $5,128,11.00 for payment
by the City of Minneapolis, under and by authority of said
Chapter 341, Minnesota Session Laws for 1933, as amended; Chapter
445, Minnesota Statutes Annotated, as'amended; and
WHEREAS, the Council of said City of Saint Paul by its
Resolution, C. F: No. 207616, approved June 12, 1962, has in all
things approved said Resolution No. 956, of said Board of Trustees
of said Sanitary District, and acts and proceedings of said
Board of Trustees, thereby represented, and by its subsequent Reso-
lution, C. F. No. 219641, approved August 18, 1964, has determined
that the most appropriate method for the financing of said
apportioned obligation of said City of Saint Paul on account of
said "Capital Additions" Sanitary District 1965 Budget item,
for payment on account of the estimated and probable cost of such
part of such expansion.of said Sewage System and Treatment Plant
proposed to be constructed during the year 1965, is that which
shall involve both the issuance and sale of Sewage Disposal Bonds
of said City authorized by Chapter 341, Minnesota Session Laws
for 1933, as amended; Chapter 445, Minnesota Statutes Annotated,
as amended., and the appropriation of available funds of said
City otherwise derived, and has thereby accordingly determined
to employ such method of financing therefor and directed the -
Corporation Counsel of said City to prepare a proper form of
Ordinance for the issuance and sale of such Sewage Disposal System
Bonds, in the par value amount of $2,500,000, authorized to
be issued and sold by said City, for said purpose and similar
purposes, by said State Statutes, as amended, and provided
that the proceeds of the issuance and sale of such bonds
thereunder, 9$2,500.000, shall be anblied to the nartiel bav-
ment of said'City's obligation on account of said apportion
to said City under said "Capital Additions" item of said
Sanitary District Budget, for and on account of the part of
the subject expansion of such

Sewage System and Treatment Plant proposed, as aforesaid, to be
constructed in the year 1965, and that additional available funds
of said City in the requisite amount be appropriated therefor
and applied to the payment of remainder of the same, according
to said State Statutes, as amended; and
WHEREAS, the construction, maintenance and operation,
by said Minneapolis -Saint Paul Sanitary District, of said Sewage
System and Treatment Plant, of said Sanitary District, for the
collection, treatment and disposal of sewage and waste materials
of said Sanitary District, which embraces both said City of
Saint Paul and said City of Minneapolis, for the joint use of
said Cities, and the aforesaid expansion of said 'Sewage System
and Treatment Plant and apportionment of the estimated and
probable cost of such expansion are authorized under and by
said Chapter 341, Minnesota Session Laws for 1933, as amended;
Chapter 445, Minnesota Statutes Annotated, as amended, and said
Council of said City of Saint Paul has determined that it is
now necessary to issue and sell Two Million Five Hundred Thousand
Dollars ($2,500,000.00), par value, of said Sewage Disposal System
Bonds of said City of Saint Paul, for said purpose, to provide
for the fixing of the details and description of the same and
to provide for the levy of taxes therefor and the pledge of the
full faith and credit of said City of Saint Paul for the payment
of the same;
NOW, THEREFORE, THE COUNCIL OF THE CITY OF SAINT PAUL
DOES ORDAIN:
Section'l. `That the City of Saint Paul shall issue and
sell the Sewage Disposal System Bonds of the City of Saint Paul in
the par value amount of Two Million Five Hundred Thousand Dollars
($2,500,000.00) authorized by Chapter 341, Minnesota Session Laws
for 1933, as amended; Chapter 445, Minnesota Statutes Annotated,
as amended,; for the purpose of the procurement of the necessary
funds in said amount for the said partial payment of the portion
of the cost of the construction during 1965 of such uncompleted
part of said proposed expansion of the Sewage Disposal System
of the Minneapolis -Saint Paul Sanitary District, due from
said City of Saint Paul, and apportioned to said City for payment,
on such account, under and by said "Capital Additions" item
of the 1965 Budget of said Sanitary District, as certified by
said Board of Trustees of said Sanitary District to the Council
of said City of Saint Paul; such expansion of such Sewage
Disposal System of said Sanitary District having been the subject
of the modification, by virtue of said Resolution of said Board
of Trustees No. 956, adopted April 91 1962, of the Comprehensive
Plan and Program of Procedure and Work for the collection, treat-
ment and disposal of sewage and waste materials of such Sanitary
District, duly adopted by said Board of Trustees of said Sanitay
District, by its Resolution on November 13, 1933, as the same
had been theretofore modified, and said Resolution No. 956
having made provision for the construction of such expansion
of such Sewage Disposal System at an estimated and probable total cost of
Twenty -one Million, Seven'Hundred Ten Thousand Dollars ($21,710,000-00)

during the years 1963, 1964 and 1965, and said Board of Trustees
of said Sanitary District, in accordance with said Resolution
956, among other things, having made due provision for the
construction of said uncompleted part of such proposed expansion
of such Sewage Disposal System during the year 1965, at an
estimated and probable cost of $9,085,964.00 and apportioned
for payment,, under said 1965 Budget of said Sanitary District,
as follows: $3 957 846.00 for payment by said'City of Saint
Paul and $5,12A,11A.00 for payment by the City of Minneapolis,
under and by authority of said Chapter 341, Minnesota Session
Laws for 1933, as amended; Chapter 445, Minnesota Statutes Annotated,
as amended. That said Sewage Disposal System Bonds of the City
of Saint Paul hereby authorized to be issued and sold shall be
designated "Sewage Disposal System Bonds, ,,Seri.es 1:964B"; and
that the proceeds of the issuance and sale of the same shall
be applied only to the said partial payment of said apportioned
obligation of said City of Saint Paul under said "Capital Addi-
tions" item of said 1965 Budget of said Sanitary District, for
the payment of the cost of the construction of the part of such
proposed expansion-.of such Sewage Disposal Plant to be done in
the year 1965.
Section 2. That said bonds shall be authorized by
resolution of the Council of said City of Saint Paul, and shall
be in the form of serial bonds and the same shall bear such
date and mature at such times as such resolution shall pre-
scribe, provided that the first installment of said bonds shall
mature not later than three (3) years from and after the date
of the same and the last installment of said bonds shall mature
not later than thirty (30) years from and after the date of _
the same; ,that no amount of principal of said bonds payable
in any calendar year shall exceed five (5) times the amount of
the smallest amount of principal maturing in any calendar year
ending three (3) years or more after the date-of issue of the
same; and that said bonds shall be issued and sold by said
City of Saint Paul, in the manner provided by law. That said
bonds shall be in such denominations as the Council shall pre-
scribe by such resolution and shall bear interest not in excess
of five per cent (5 %) per annum payable semiannually according
to interest coupons to be attached to the same; that said bonds
shall be in the form prescribed by the Council of said City and
approved by its Corporation Counsel; and that said bonds shall
bear such interest as said City Council shall prescribe and shall
be sold by said City Council for not less than par value plus
accrued interest, to the highest bidder therefor, after two
weeks' published notice of the time acid place for receiving bids
thereon. That the proceeds..from the issuance and sale of said
bonds, as•received by said City, shall be deposited by it in the
Sinking Fund of said City or in 'a Special Fund of said City and
allocated thereto and sub jmt to the disbursement only for the
purposes aforesaid. That the full faith and credit of said City
of Saint Paul hereby are irrevocably pledged for the prompt
and faithful payment of both principal and interest of said
bonds and the proceeds of the issuance and sale of said bonds
hereby are appropriated and shall be used solely for the purposes
set forth in Section 1. That said bonds of said City of Saint
Paul shall be payable in lawful money of the United States of
America.fJ:.
Section 3. That each of said bonds shall be sealed by the
..facsimile of the Official Seal of said City lithographed thereon
and signed by the lighographed facsimile signature of its
Mayor, attested by the lithographed facsimile signature of
its City Clerk and countersigned, mahually, by the City C Fp-troller

Section 4. That said City's proper officers hereby
are authorized, directed and required to set aside annually from
the revenues of said City an amount sufficient for the payment
of the interest on said hereby authorized bonds and the principal
of any such bonds maturing in such year and hereby are authorized,
directed_ and required to make a fufficient tax levy for the
payment of the same under and pursuant to the provisions of Chapter
475, Minnesota Statutes 1961,'as amended. That such tax levies
for all years shall be specified and shall be such that if collected
in full they, together with estimated collections of other revenues
pledged for the payment of said obligations, will produce at
least five per cent (5�) in excess of the amount needed to meet,
when due, the principal and interest - payments on said bonds.
That each such tax levy shall be by resolution of the Council
of said City, which shall, among other things,irrevocably
appropriate the taxes thereby levied for payments,,,when due,
of the principal and interest of said bonds. That such provisions
of this Section are in addition to the pledge of the'full faith
and credit of said City for the payment of said Bonds and are not
in lieu of such pledge.
Section 5. That the principal and interest coming
due prior to the receipt of the proceeds of said taxes shall be
paid promptly when due, out of the general funds of said City
of Saint Paul, and reimbursement therefor shall be made when said
taxes shall have been received. And the City Clerk of said
City of Saint Paul is hereby instructed to file in the office
of the County Auditor of,Ramsey County, Minnesota, a certified
'copy of this ordinance, together will full information regarding
the,- bonds for-which this itax„ is levied, and the City Clerk is
hereby ordered and directed to secure from the County Auditor
a certificate that he has entered the obligations in the tax
register as required under the provision of Chapter 475,
Minnesota Statutes•1961,;as amended, and that the tax levy required
for the purpose has been made. Before the said bonds shall
be delivered to::the purchaser_, the Council of the City of
Saint Paul shall obtain from the County Auditor and deliver
to the purchaser, a certificate of the County Auditor that
„ the issue has.been entered on,rhis register and that a tax has
been levied'as required'by - law, in accordance with the provisions
of Chapter- 475, Minnesota - Statutes 1961, as amended. Such
taxes shall'be collected and payment thereof enforced at the
same, :time- and.with and in like manner as other taxes of the
:City- of'Saint Paul, and when collected shall be used solely
'-fbr` paying • the interest and principal of said bonds when and
as -the same shall `,mature,.

$ WHEREAS, The Board of Trustees of the Minneapolis -Saint Paul Sanitary
District on November 13, 1933 adopted a resolution adopting a• comprehensive plan
and program of procedure and work for the construction of the Sanitary District
sewerage system and treatment plant in accordance with Chapter 3419 Laws of
Minnesota, 1933, and
WHEREAS, It, appears desirable and expedient to modify such program of
procedure and work at this time by capital additions thereto, and
WHEREAS, Said Chapter 341, Minnesota Session Laws of 1933 provides that
such modification may be made from time to time by the said Board of Trustees, and
.WHEREAS, The general purpose and object of this Sanitary District is to
promote health and welfare by providing an adequate and efficient system and means
of collIcting, conveying, pumping, treatment, and disposal of all domestic sewage,
commercial and industrial wastes and their products within its own territory so as
not to endanger public health and cause nuisance, and
WHEREAS, The growth in population and industrial expansion in Minneapolis
and Saint Paul and particularly in the suburban areas presently connected thereto
for sewage disposal service has resulted in an ever - increasing demand upon the
facilities of the Sanitary District's sewage treatment plant to the point that
certain of said facilities are overloaded and inadequate,
NOW, THEREFORE, BE IT RESOLVED, That the Board of Trustees of the
Minneapolis -Saint Paul Sanitary District does hereby further modify said program,
commonly referred to as Project I -10 as modified, to provide for the expansion of
the treatment plant so as to afford additional capacity as well as provide second-
ary treatment by the high -rate activated sludge process, and concurs in the
recommendations made by its consulting engineers, Toltz, King, Duvall, Anderson
and Associates, Inc., in their final report -- Volume 4- -dated November 1961, and
their letters dated March,21, 1962, Board File 6376, and April 2, 1962, Board File

except as hereinafter provided, and
BE IT FURTHER RESOLVED, That said Board of Trustees adopts the time
schedule as suggested in Board Files 63329 6376, 63771 and 63799 providing for a

three -year construction program, except as hereinafter provided, and
BE IT FURTHER RESOLVED, That said proposed plant expansion is hereby de-
termined to be the most efficient and economical as well as proper and reasonable,
and said Board of Trustees,.adopts the estimates as shown in detail on charts and
tables attached to or contained in said Board Files hereinabove referred to, and
now being on-file in the office of said Sanitary District, as its estimate of
probable cost of such additions for plant expansion for the entire District based
on the probable needs and requirements of the District and its presently connected
areas, except that the Board may, in their discretion, alter said plans, programs,
financing, and the timing of construction phases, and
BE IT FURTHER RESOLVED, That the portion of the Sanitary District's
budget commonly referred to as "Capital Additions" and set forth in Board Files
6377 and 6379 is hereby adopted for the year 1963 in the amount of $79182,300.00
of which $3,2839747.56 will be apportioned to the City of Saint Paul and
$3,898,552.44 to the City of Minneapolis.
