WHEREAS, the property at 615 Elfelt Street, being described as:

EL OF SD LOT 12 DIST 99 FT N FROM SE COR THEREOF TO A PT ON
WL OF SD LOT 12 DIST 98.6 FT N FROM SW COR OF SD LOT 12 BLK 27,
LAFONDS ADDITION TO SAINT PAUL, MINNESOTA
with the property identification number of 36-29-23-12-0165 was assessed an amount of
$4,704.11 for the removal of a diseased elm tree, and
WHEREAS, at the request of the property owners, the Forestry Unit of Parks and
Recreation for the City of St. Paul investigated the removal of the diseased elm tree and
determined the above property at 615 Elfelt Street was mistakeniy assessed since the tree
was in the public right of way, and
WHEREAS, the Real Estate Division processed a payment for the above assessment plus
$59.93 interest on May 8, 2006 from Edina Realty Title; so
THEREFORE BE IT RESOLVED, that the amount foz the assessment plus interest
equaling $4,764.04 be reimbursed to Edina Realty Title for the assessment to the property at
615 Elfeit Street, and
BE IT FURTHER RESOLVED, that the reduction of $4,704.11 be funded by the Right-
of-Way Maintenance Fund.

improvement, and said assessment having been further considered by the Council,
and having been considered finally satisfactory, therefore, be it
RESOLVED, That the said assessment be anrl the same is hereby in a11
respects ratified.
RESOLVED FIIRTHER, That the said assessment be and it is hereby determined
to be payable in One equal installments, Except file's J0564C, 30505C to be
payable in Ten equal installments and file O501T to be payable in Twentv equal
installments.

and then we went out and investaged.

IYs just me again - were both assessments canceled for the same reason? I am told that the person who
lives in Florida is the former owner of the properiy on Elfeft, so I know your message most likely applies to
that property, but was the assessment on Cumberland canceled for the same reason? Pardon my need
for ciar'rfication; i'm just trying to make sure we are documenting the correct information on this.

After the hearings, owner, who lives in Florida called and complained. Upon investigation it was
determined that the trees were on a R.O.W. and that is why they are canceled.

Hello!
Regarding the canceled assessment for these ones, can you tell us W HY they were canceled? If a tree
was on someone eise's property, we need to know which property it was on so it can be re-assessed to
the correct property. If it was a notification problem or something else we need to know that, too.
Whatever the reason is that an assessment is eliminated, we need to know so we can include it in the
Council Resolution to correct the problem.
