WHEREAS, in the matter of the construction of the BATTLE CREEK
SANITARY SEWER SYSTEM SOUTH INTERCEPTOR - SECTION I, Comptroller's
_r Contract L -65835 Hurley Construction Company, contractor, the
specified date of completion is October 1, 1963, and
WHEREAS, under adverse conditions, the contractor prosecuted the
work as diligently as possible, but due to delays in the execution
of the necessary contract documents, pre- requisite to commence-
ment of work, and the encountering of excessive water conditions,
the sewer work was not completed before the onset of winter,
necessitating the postponment of the street restoration work until
the current construction season, all of which resulted in the
contract not being completed by the specified completion date,
therefore, be it
RESOLVED, That the proper city officials be and they are hereby
authorized and directed to execute an amendment to said contract
extending the time of completion to JUNE 24, 1964, provided
however, that this resolution shall have no force or effect,
unless the sureties on the contractor's bond consent thereto in
writing and file such consent with the City Comptroller, and be it
TFURTHER RESOLVED, that the City of St. Paul hereby waives all claim
for liquidated damages and that no engineering and inspection
All costs on this project will be:i'charged to the contractor on account
of such extended period.
