That the Zoning Code, Chapters 60 to 64, inclusive, of the Saint Paul Legislative Code, pertaining to Use Districts, Height Districts, and Rezoning of certain pro- perties in the City of Saint Paul, as amended, be and the same is hereby further amended so as to rezone the following des- cribed property from "A" Residence District to "C" Residence District, to -wit: "Lot Five (5), Block One (1), Brenner Addition;" situated on the northeast corner of Clarence Street and Maryland Avenue in Saint Paul. Said property to be used for nursing home purposes only. Section 2. Hefty to rezone from "A" residence to "C" residence property located at the northeast corner of Clarence Street and Maryland Avenue which is described as Lot 5, Block 1, Brenner Addition.- The subject property is part of a larger tract sought to be rezoned to "C" residence for apartment development in 1962 which was denied by the Council. On April 7, 1964, the Commissioner of Finance reported the petition \ sufficient with the owners of 10 of a possible 18 (66 2/3 %) tracts of land within the prescribed 100 foot radius having signed the petition. Mrs.Hefty has indicated on the petition that she proposes to use the single - family dwelling on the premises for a Boarding Care facility. The Board of Zoning considered this petition at its regular meeting on May 14, 1964. After hearing a report from the City Architect relative to the conditions existing in the home, and taking into - consideration the uses in the neighborhood, the Board concluded that this was not a proper location for a facility of this type.
