Some of these licenses are considered Class N; therefore, neighbors were notified. I received one letter via e-mail by the scheduled response date of September 22, 2006. The letter was received from Dave Finke, address of 568 Dayton Avenue. Mr. Finke's only concern was that the previous restaurant at this location, the Vintage, had strong, rotting garbage smells emitting from their container during the hot summer months. Mr. Finke said that he was promised by one of the previous owners that care would be taken to ensure that garbage smells would be avoided, but that was not carried through. Mr. Finke wanted to make sure that I-1 Vescovino would not have this problem. Racquel Naylor, Secretary, spoke to Jim Risimini and asked if he would accept a condition about garbage picked up. Mr. Risimini said yes and that he plans to have garbage picked up three times a week and all garbage wili be bagged. He said that the previous restaurant owners did not put bagged garbage into the container. Ms. Naylor then taiked to Mr. Finke and asked would he be okay with this license being approved if there was a condition about garbage pick-up three times a week and that only bagged garbage wouid be put into the containers. Mr. Finke responded "Absolutely." He said that Mr. Risimini wants to open October 1, and Mr. Finke hoped that could be accommodated. The office of License, Inspections, Environmentai Protection has recommended 3 conditions for this ticense application. Given all above information, I am recommending that the City Councii approve the resolution to grant the licenses for 11 Vescovino with the three conditions recommended by LIEP and the new condition that Mr. Risimini has accepted. All the conditions are as follows: 1) Patio must close no later than 11:00 p.m. on Sundays, 2) Forty-seven (47) off street parking spaces must be provided and the parking lot must be developed in accordance with the zoning approved site plan, 3) Per City of Saint Paui Legislative Code 411.02, the definition of Entertainment A is "Ampiifiied or nonamplified music and/or singing by performers without limitation as to number, and group singing participated in by patro�s of the establishment," and 4) Garbage wiil be picked up at least 3 times a week and only bagged garbage will be placed in the ga�bage container.
