1 WHEREAS, Walter J. Chojnowski, owner of a home at 1254 McKnight Road South in Maplewood, has
2 requested permission to connect his property to the Saint Paul sanitary sewer located in McKnight Road because
3 his septic system has failed and Maplewood does not have a sewer available to serve his property, and
4
5 WHEREAS, Section 79A1 of the I.egislative Code states that before any property located outside the city
6 limits connects its sanitary sewer to the Saint Paul's sewer system, authorization must be obtained by a
7 resolution from the Saint Paul City Council, and

WHEREAS, Walter J. Chojnowski, has agreed to pay all costs of publication necessary for this resolution,
hire an approved House Drain Contractor, obtain a Saint Paul Sewer Utility Permit, pay an Advance
Assessment for the sewer connection, and pay the Sewer Availability Chazge fee to the City of Maplewood, and
WHEREAS, The City of Maplewood has stated that it is willing to allow Mr. Chojnowski's request, and in
order to do so, has requested that the 5aint Paul City Council authorize the connection, and
WHEREAS, The Director of the Department of Public Works recommends that the City Council authorize
the said sanitary sewer connection, subject to the terms and conditions set forth in Chapter 79 of the
Legislative Code and the concurrence by the City of Maplewood.
NOW THEREFORE, BE IT RESOLVED, that the Council of the City of Saint Paul does authorize and permit
Walter J. Chojnowski to connect his property at 1254 McKnight Road South to the Saint Paul sanitary sewer
system, subject to the terms and conditions of Chapter 79, as amended and also subject to the additional
condirion that the property shall be disconnected from the Saint Paul sewer system and connected to the
Maplewood system upon the construction by or for the City of Maplewood of a public sanitary sewer abutting
this property.

Walter Chojnowski, the owner of a home at 1254 McKnight Road in Nlaplewood wishes to connect his house tkain to a public sewer to
eliminate his failed septic system. The Ciry of Maplewood does not have a sewer available to serve him, but Saint Paul does.
Maplewood has agreed to ailow this connecrion [o our sewer. Section 79.01 of ow Legislative Code requires that the City Counc$
