LAIS CORPORATION COUNSEL +s, April 13, 1964 To the Honorable Mayor and the Council, of the City of Saint Paul Re: Memorandum Opinion - Sufficiency of Requests for Withdrawal-of Assents to Rezoning Petition Gentlemen: On April 2, 1964 the City Council referred to this office and to the undersigned the matter relating to the Rezoning of the west half of Lot 7,, and all of Lots 8, 9 & 10, Block 1, Bryant's Addition to St. Paul, the same to be rezoned from "B" Residence to "C" Residence under the Zoning Ordinance of the City of Saint Paul. At the time of Council hearing, April 20 1964, owners of four parcels, presumably within the 100 -foot radius of the real estate sought to be rezoned, have through the medium of a person appearing in opposition to said Rezoning Petition, presented to the Council, and "to whom it may concern ", letters requesting that their names be withdrawn from the Petition for Rezoning. This matter has been previously discussed by the Council in an opinion written January 12, 1961 by Louis P. Sheahan, Direc- tor of Law of the City of Saint Paul. In said opinion Mr. Sheahan referred to the case of Jefferson Highway Trans ortation Company vs. City of Saint C1'oud and Others, 155 Minn. 463. In t at case it was clearly held that once a petition in the form of a referendum petition has been certified through the City Council after its pre- sentation to the appropriate official for certification, withdraw- als of names on the petition may not be effectuated. The rationale for the Jefferson Highway case is, of course, the confusion, redundancy and the clogging of legislative matters appearing before the City Council. It was then and, in the opin- ion of the undersigned, is now the general rule that petitions for rezoning, having once been certified by the appropriate City official as being in proper order, and thus presented to the City Council, may not be deprived of its jurisdictional life by means of an attempted withdrawal of signatures. Were the rule other- wise, matters of this nature would constantly be flitting in and out of Council meetings with the Council being deprived of the opportunity of taking.proper governmental action and terminating— thereby the matter presented to it. It r v. To the Honorable Mayor Page two April 13, 1964 and the Council of the City of Saint Paul This rule as enunciated is somewhat different from that set forth in the case of Henry C. Domeier vs. Richard A. Golling , 243 Minn. 237, wherein a petition from freeholders in the munic - ipality of Sleepy Eye requested the public examiner to perform certain duties for the municipality and after the commencement of some work by the public examiner and his staff, a duly certified second petition was presented to said public examiner withdraw- ing sufficient names from the original petition to provide less than the minimum required by statute. Justice Christiansen held that the right to withdraw names from the petition was of such nature that, where the withdrawal petition was timely and proper in form, the same was to be given effect. In his opinion, Justice Christiansen however differentiated between the Domeier case and the Jefferson Highway case and by implication has affirmed the position of the Jefferson Highway case. Relating this matter to the petition presently before Council as referred to in the first paragraph hereof, the Domeier case presents facts which are dif- ferent and distinguishable from the instant situation.0 In the instant matter, the petition -,as originally drafted was referred to the appropriate City official for determination as to suffi- ciency. This official, to -wit: the Commissioner of Finance, has reported as of February.17, 1964 that the petition is sufficient. Hearings have been held by the Zoning Board and the matter is now presented to the Council, all having been accomplished as a part of an orderly procedure. In view of the fact of the certifica- tion by the Commissioner of Finance of the sufficiency of said petition, as well as.the action by the Zoning Board although the action of said Board is not necessarily that which gives addi- tional life to the petition, it is my opinion that the requested withdrawals of assents to said petition are without effect at this time and do not, therefore, have any effect as to the suf- ficiency of the petition for rezoning. It should not' be construed, however, that this opinion limits the right of the City Council to consider the position as presented through the requests for withdrawals. This opinion holds that the petition as presented is sufficient, notwithstanding the ineffective but.attempted withdrawals; it does not limit the power of the Council to consider the letters of attempted withdrawal which now constitute a part of the file. Inc. and F. C. Horner to rezone from - "B" to "C" residence property located on the south side of Laurel Avenue between Avon and Victoria Streets which is described as the west J of Lot 7 and all of Lots 8, 9, 10, Block 1, Bryant's Addition. On February 17;1964, the Commissioner of Finance reported the petition sufficient with! the owners of 13 of a possible 19 (68.427o) tracts of land within the prescribed 100 foot radius having signed the petition. The west one -half of the subject property is developed with a large, tbree - family residence and the east one -half of the tract is now-yard area for the existing residence.. The petitioner has indicated that he wishes- to�divide the subject property into two equal tracts, to develop the easterly one -half of the site with a nine -unit apartment structure and remodel the existing three - family residence to accomodate additional units;. The property has a frontage of 140.07 feet and a depth of approximately 228.2 feet.and results in an area of approxi- mately 17,963 square feet. The Board of Zoning considered this matter at its regular meeting on March 5, 1964, and concluded that because the area is now developed, for the most part, with single and two - family residences, and a few scattered multi - family uses - consisting of three, four and five - family type, the proposed use would not bye compatible with the existing uses and would constitute "Spot zoning ".
